I think the answer depends upon the value of the item sent you. Sometimes the hassle of returning etc. would cost more than the item is worth.

Well that's down to the retailer to decide whether its worth it.

The issue is they did not do what was instructed so my question is would you keep both if they did this to you? Seems I upset a lot of people by asking this however lol

    Haven't upset anyone.

I'm amazed you needed to ask the question

What would I do, I would ask replacement item is cancelled if possible or refuse delivery if its too late.

no thats why im posting here.. i feel guilty so I think I should just return it.... right? =\

    or am I being stupid?

Where do I stand legally... can i be prosecuted or can the neighbour be?

How could anybody with a shred of honesty even think to ask this? Notify the company and they'll arrange for it to be collected.

Are you annoyed it wasn't left outside your house because you were planning on saying it had been stolen?

    Well the OP did state:

"It would be my responsibility should it have been stolen [from the driveway] but thats not an issue because I wouldnt of set those instructions"

Which I agree with you does sound quite suspect (nobody would just write off an item were it stolen from them whilst still technically in transit).
