I need help.
My partner of 4 years and I borrowed 80k from his sister, paid off his 32.5k mortgage and bought a 255k house. I owned a property with no equity which I sold. I had around 8k in cash which my partner has made a nice big dent in.
the sister has a deed of trust on our property for 47k which is the deposit she gave us for our house.
The house is now worth 235k potentially, and if we sold, there would be 20k negative on the amount his sister gave us, although the mortgage is not in negative because of the deposit she gave us.
I do not have the money to pay my proportion of the negative, and would have no house either, (probably be unable to get a mortgage) whereas my partner would return to his property and remortgage. That house is worth approx 100k
what I need to know is, would his sister be able to take me to court to get the money? It wasn't lent to me directly and never went into my bank. Can a court force me to pay her? The thought of losing my partner, my home and walking away with a debt when I've never even had a credit card scares the hell out of me....
I'm tempted to say, let's stick it out in the house for now, I can comfortably afford to live there and pay my half of the bills, yet she is now saying after 3 years she is desperate for the money (understandably) but yet if she forces us to sell in this market it'll get less than if we waited.
If I play hardball can I be taken to court?0 -

There are various methods of selling houses without an estate agent. Either you use classified websites or there are fixed fee websites which will list your home on the major websites used by estate agents. Sellownhome.co.uk have a few options which might be usefull.0

my home has been on the market for ages and i kinda need to sell it...... i have two and the cost is driving me and my wife mad. its been on the market for almost a year and im thinking of one of thoses homebuyers sites???? does anyone no of any good ones??? or any ideas as to where and who to sell too????

From a property professional's website;

"The reality (and something you need to be in no doubt about) is that 99.99% of the 1000's of quick sales we've observed have gone through at 70-75% of the property's "Realistic Value"."
"At the last minute they will reduce their offer and we've seen a number of people, settling out of sheer desperation (especially true if you're facing repossession), for 40-50% of their property's true worth."
Rather than use shysters why not just drop another 5% or 10% off, to shift it, and keep the 15% or so they would steal from you.
Or go to auction, set the reserve at you "must get" figure.Act in haste, repent at leisure.

A friend pointed me here, as I have recently sold my house. There are some interesting posts and stories! I have found things tough too.
I had some luck and success using comparethehouses.com. It's a site where you can sell your house privately and there is no charge. I was surprised how easy it was to use.
I think some of the online estate agents look interesting, but a friend had had a bad experience with isold, so I thought I'll try this for a few months and guess I was just lucky.
