There is always a risk of that, I would recommend having someone with you if possible when you conduct viewings, and never leave them on their own for too long. Also, bear in mind that Estate Agents don't generally vet their buyers so the risk can be the same, especially with some Estate Agents having an open house. Always keep valuables out of sight.0

hi i will be renewing my mortgage in may 2008 and want to sell and buy another property.
my question is i have 2 defaults on my credit file that are incorrect one from o2 which says i owe them £369 i have contacted 02 who says i dont owe then anything and default should never been issued but still having problems getting them to remove this from my file.
2. abbey says i owe them £522 i dont i owe then 240 which i have offered to give them.. they did not issue me with a default notice and i have written to them on several occassions to which they have never replied they totalling the 522 as charges but am refusing to pay this as it was agreed i would pay the 24o and all would be ok... and no default would be added....
i know this will affect me getting a mortgage can anyone explain what would happen and how else i can fet those removed as dont want to still have these when i remortgage experian has told me that the bank has boobed but seem to be getting nowhere with them

I have recently sold my house and the Estate Agent was unprofessional in the extreme. He has a link on his website to the NAEA but when I contacted them he is not a member. He also has a similar name to a big chain of estate agents which is confusing.
Anyway I refused to pay for many reasons which I stated in a letter to him so without any chance of negotiation he is taking me to court.
His case is based on a signed contract but the contract was signed by my boyfriend unbeknown to me. I tried to sack him after 7 1/2 weeks and he said I was obligated to stay for 12. This was the first I knew of any contract but he said I had signed it. It was only after the house was sold I realised that I hadn't signed.
Can he take me to court if I didn't sign the contract (I owned the house on my own).0 -
There will be an assumption that by agreeing to the marketing and accepting an offer, that you agreed to the contract, regardless of signing it.
If you want to renegotiate with an EA on poor service then you really need to do so before the bill arrives
You owe the money. Whatever happened with him, a buyer was found and he must be entitled to at least part of the fee based on that.Everything that is supposed to be in heaven is already here on earth.

My first post and I just wanted to say thanks for the great advise. I have sold 4 properties in the past, and until last week I was unaware that you could haggle. I had 3 lots of EAs round and they all looked at me as if I had 2 heads when I said I wasn't prepared to pay what they were asking. I have now found an EA who is not only doing 1% with no lock in, but no VAT either! Result!0 -

Also find out if they use local energy assessors - mine tried to send a guy (and shadow !) up from London (to the Midlands)...when the assessor phoned to book appointment and explained, i went ballistic .............i then contacted a local assessor, ended up getting not only my epc cheaper (and less carbon), but a very much cheaper hip quote....very much.0

The contract should say something along the lines of -- are you the owner of the property, --or -- are you authorised by the owner ....blah blah.
If not, don't see how he can take you to court IMO
Else, make it known to the court that he is simply using the court for corporate bullying ...or along those lines ....judges take a very dim view of that ......agin only my opinion0 -
