This is a money saving site. This forum is about eBay. I don't know where you post most on this site, but here we give advice that won't lose a seller money or fall foul of eBay t&c.
To the best of my knowledge there is no breach of rules/regulations/mythical legislation in selling Office 365 licences. The ones that come with tablets etc are NOT OEM licences but standard licences as you would buy in PCworld etc, so free to be sold/resold. OS licences are a different matter.
FWIW the O365 licence that came with my Tesco Connect was a standard retail type licence, The only thing missing was the physical box that a licence purchased in a shop comes in, and that box's only purpose is to give the product more bulk to deter shoplifting.
Office 2010/2013/2016 cab be either OEM or retail and have perpetual licences (ignoring HUP products)
Office 365 is a consumer subscription model with annual or monthly subscriptions.
