    I'm surprised that if you presented with a hernia 7 years the specialist didn't operate as it's a routine operation... instead they have spents £1000's and many many man hours on tests as well. Forget what your doctor friend thinks as he obviously hasn't been privy to your results and hospital records (I assume).

    Speak to PALS who are hospital based and ask them to intervene on your behalf.... They should be able to supply you with some clarity over the situation.

    Yup... + the intermittent suffering i had endure + amount of anti'inflammatory and other rubbish drugs I was fed....
    ...and that is exactly what "associate"- friend- doctor was saying...:mad:

    Hope makes sense, as why I am getting irritated and apart from wanting a treatment, I want acknowledgment, that they are negligent? ;)

    "PALS thingy", certainly should work or to make them work, I think and hope, but first thought, that is not leaving me yet, is to address everything via appropriate solicitor :o

    Not all hernias can be treated with surgery, there are risks involved. Have you asked the consultant the reason for not operating?

    Last time seen "specialist" himself near a year ago and all he said, "we are going to need to investigate further..."
    Waste of time, man hours, money, possible further complications health ways- seems like negligence to me! :(

    It or not be negligence but you need to address a complaint direct to the hospital first before getting solicitors involved.... PALS will be the people to help. Bringing a case against a hospital is a very stressful drawn out process which on average can take years and be extremely costly, a solicitor won't take the case on unless they are confident of a win...By going through PALS you are likely to have the operation fairly quickly, if it is deemed necessary... The outcome may very will be that the operation is not beneficial to you and that's why after so many years and numerous tests etc is the reason it's not been done.

    Well, I can literally see, exact excuses said to me or the solicitor... though he had never said so, so far!

    However, again, time, suffering and frustration, I had endure... still tempted to speak to solicitor first

    If you can't afford private healthcare then you won't be able to afford a solicitor to do what you wish. They're not going to work on a conditional fee basis until you do some of the legwork and find out why your desired treatment has not been offered. As has been repeatedly suggested to you, PALS can help you with that. Until they have that information they cannot judge whether it is in their interests to work for you (they'll only do so if there is a high chance of success).

    I do wonder if your communication difficulties are part of the issue. Is there someone with better English that can help you with this?

    Hence "leg work" here, to see what are the options to have sensible consultation with one and considering nonsense of the cases solicitors do bring all the way to courts... where on surface seems like plain negligence.

    As it comes to benefit or not to operate- it is useless to be asking same "specialist" opinion, I will have to seek answers alternative ways (PALS included)

    As it comes to English- it is certainly good enough and importantly it seems to me as an self-explanatory reason for maltreatment indeed. TY, good tip!

    The people you need to speak to are the AvMA, they're a charity set up to provide legal assistance to those who are suing the NHS. They will be able to advise you whether a solicitor is the right course of action and help you find a suitable solicitor.

    Don't expect anything from the PALS in a hurry, the NHS complaint system is designed to give people the run around in the hope that they'll give up and go away, the Health Ombudsman has published yet another report this week criticising them for just that. But then, the Ombudsman also gets panned for doing the same: the Rt Hon Quintin Hogg criticised the PHSO in parliament as a "swindle" and a "fraud" for leading patients to believe they're getting a fair investigation when the system is actually rigged against them.

    My complaint went in last June, and I still haven't had any reply, but you're not allowed to escalate to the Ombudsman until it's gone six months. There's someone else on this forum who has had a complaint running for two years with no resolution, three or four years is not uncommon I gather.

    If you decide to go via PALS you have a right to an "independent" advocate to assist you in preparing your complaint, but be very wary, they're not independent. Mine was an ex-NHS employee who was finding excuses to tone down the complaint and throw out as much as possible, the more you concede the more they try it on. I don't know who the advocacy service is for Surrey, it might be Healthwatch, but there are loads of different ones depending on where you are in the country. It took me weeks to find the correct one for my area, again another runaround designed to deter you.
