Newbie question - UK Car Park Management (IPC) - should I appeal?

ZNOOOOO!
The Parking Cowboys 'appeal' is not a good appeal template. In fact it's hardly an appeal at all, it's just a series of 'clever d|ck' questions.
I know what you mean about being a series of clever d|ck questions, but I guess the part that impressed me somewhat is that there are requests for info which I thought some of these companies wouldn't want to spend time sending to me, so would dismiss the PCN?0 -

A PPC is only after your money and do not just dismiss the PCN
A series of questions, they will ignore and continue with their threats, that is the way with these morons. Plus they will pick on people who they think are weak.
Appealing to the IAS really is a waste of time as they practice incest with Gladstones Solicitors. You can try but it will fail, then you have Gladstones who are very nasty but all they are after is your money and to protect the PPC, that is why this sham has been set up.
This a game to play so firstly ask the PPC for a full breakdown of the charge and that you require a VAT invoice meaning they must show the VAT element. The HMRC is very clear that if it is a contract then it is subject to VAT.
Nobody can be expected to pay a bill with no breakdown, even a judge would not do that.
You have then legally asked the question and as we all know, the PPC will ignore or write back some rubbish that they are not obliged to tell you. That is complete junk.
The reason for a complete breakdown is to see the allocation of funds on say a £100 fine.
Just like your gas bill where it shows all the units and how much they are.
This has no bearing on the Beavis case as his claiim was that charge was unfair .... you are not saying that.
In a recent county court case, the judge made it very clear that the amount cannot include items that are normally known as business expenses such as paper, utilities, uniforms, petrol etc etc.
Such expenses can be claimed back via the normal government systems.
Therefore, the amount of £85 / £100 must have been derived from somewhere and therefore a breakdown is required
Most PPC will ignore you but as long as you have done this, just sit and wait. If the PPC starts to threaten you with debt collectors etc etc, you can then refer to your request for a breakdown but this time you are entitled to charge them £25 for your letter and this time a harassment charge of £100. Easy to do a quick invoice on your PC. They will of course reject it but no matter, in the highly unlikely event that they are foolish enough to take you to court. the question must be posed to the judge that you have tried to sort it out but the PPC refuses to reply and harasses you thereafter
And if they ignore your claim and still harass you, then its another £25 letter and an increased harassment charge.
The charge they applied by way of an invoice is only a piece of paper as will yours be
THE CHASE IS ON0 -
Just to put this as facts to you
Before the PPI scandal with the banks, there was another scam that was exposed by Martin Lewis.
This was the charges scam banks applied when you went into the red and they kept on coming building up £100's of debt for customers.
The question then was for a breakdown of these charges which the banks ignored. People were taking the banks to court in their droves and the banks did not turn up. that is because they had no answer.
It got so bad that the courts placed a ban on further cases until a higher authority ruled on it. That never happened. It cost the banks dearly and because of the ban, the banks had to refund eroneous charges until a further ruling.
The courts right now are fully aware of the PPC's and the bully boy tactics they employ. The time gets closer that the same will happen as with the banks0 -
Beamerguy - this is great, thank you very much, and what seems to be the best route to go down.
I saw the other idea of finding out who hired the PPC and asking them to cancel - this will be my local hospital whose grounds I parked within but don't think they would want to get involved and probably just refer me back to the PPC?
Now I understand more about the BPA and IPC setup, I can't believe this IPC scheme exists for these cowboys to hide behind...!!0 -

Hi, I know, of course there are some on here that will disagree with me. This is the way I do things and it works. Welcome to the world of Rogue Traders
I doubt the hospital will want to know especially as they probably get a commission from each ticket paid ???
I am assuming you are a young mum so in your letter it will be worth mentioning that in the opening paragraph.
Courts do not like young mums being harassed0 -
The puzzle for everyone about Gladstones Solicitors is they have got themselves involved in this trickery yet fail to see that if someone was seeking a solicitor in the Knutsford area for whatever reason, via google search. Gladstones appear. Then they explore more about Gladstones up comes everything about them and the incestuous business they run.
If I were looking for a good professional solicitor, after reading all about them, I would avoid them like the plague.
They are destroying their core business and making themselves
look like complete idiots. They do say that a fool and his money is easily parted ???0 -

If you were a hospital patient or visiting a patient then, in parallel with appealing to the PPC (using the template from the newbies sticky), get in touch with the hospital's Patient Advice and Liaison Service (PALS) and ask them to intervene. They are supposed to be on the patients' side.
Many have had success via PALS (but not always). Lay as much 'mitigation' on them as possible. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Some good advice from beamerguy. On the VAT issue, you tell them that you are unable to consider their invoice till you receive a proper VAT invoice from them and please can you have it.
The important thing here is how you word it, By saying that you are unable to consider it as things stand, you are not refusing to pay but are awaiting a properly constituted invoice and putting the ball back in their court.
That means that should this get to court, you have a very strong case by saying that the matter is ongoing and that you are properly entitled to legally compliant documentation before parting with your money.0 -

Perfect advice
This is the way forward now, do remember the little habit they have of saying "this is our final response"
The final response is ONLY when "the fat lady sings" and not before0 -
