The software update that they are supposedly installing in the new year, will probably effect efficiency and emissions. I can't see it not doing so as they wouldn't have had to create the cheat in the first place.

I have been seeing differing reports in the media, ranging from VW claiming to not have been breaching European Law with the cheat device, to VW preparing to buy the cars back.

But, I do know somebody that was part exchanging his Audi for another brand, at a main dealership. The deal was done a month ago, but prior to him collecting his new car, the dealer rang him to say the deal is off because of the scandal that surrounds the emissions. (whether that's right or wrong is immaterial). What bothers me is if I can't part ex my car, or sell it at the sort of price I would have expected to get for it, had it not been for the scandal.

    Self fulfilling prophecy really.

People got hysterical and assuming the worst with no evidence to back it up, so dealers get jumpy and values go down

You have suffered no material loss, so why do you expect compensation?

When a dealership is not going to accept your affected car as part exchange, I'd call that a loss.
And until VW officially lets us know what effect the fix will have, we will lose on depreciation

    Irrelevant.

You buy a car at a price because you are happy to buy it for that price, at that point in time.

There is no guarantee against the future value of a car (excluding PCP deals). It is a risk you take when you buy a car.

    When A dealership...

One dealership. Go elsewhere. Their loss.

Also, VW have said they will rectify the affected cars. How they do it is largely immaterial.

The emissions are only obtainable during the factory tests and you will not replicate that in normal use.

So as to saving the planet then the only option is to walk.

Not interested in compensation! Bought a car that had the right balance of economy and emissions. It now doesn't comply with the stated emission values that were advertised.
I would like to roll back the deal and purchase a vehicle that does achieve the values I require.

The car has exactly the same balance of economy and emissions as when you bought it. The only time that the "cheat device" kicks in is when the car is on a ramp being tested for a very specific compound which is not part of the UK tests. I assume that you don't drive it on a ramp very often so will be unaffected by it.
Remember the saying: if it looks too good to be true it almost certainly is.

    Account No: xxxxx

Sales of Goods Act 1979 & Misrepresentation Act 1967

On 00/00/0000 I entered into a Hire Purchase agreement with you for the following:

Skoda Fabia -ZZ0000ZZ from name of garage

I now have a problem with the goods:
The emissions published based on vehicle and used at the point of sale are incorrect,

I would like to argue the goods are not as described and any changes made to the vehicle in a bid to rectify this issue must not affect the feel and performance of the vehicle as these were factors all used during the point of sale.

I understand that under the above legislation, it is your responsibility to resolve the matter and would therefore ask that this is done within the next 14 days.

    Yours sincerely
