Car tax refund paid short by DVLA

The refund is based in the 12 month price, 6 month tax has a 10% fee added on which is non refundable.
It took 3 letters to get them to explain that it's based on the 12 month amount.
I wonder how much DVLA are making out of the"new" system, I akin it to how the Banks use to behave. In my case DVLA had the tax for the month of May for both my old and new car (my fault for not waiting a few days) but they also had the revenue for the month of June from, me for my old car (the money I am try to get back), the new owner of the same car and for my new car. This "new" system has been designed to make more revenue! rant over..:mad:0 -

In hindsight (yes we all have 50/50) I should have sent it "signed for", never though their was a need to do this as I have never had a problem before-lesson learn't!
I have little faith with any letter going to any government department, I'll always drop it in at my local PO and ask for proof of posting, it's free and gives you proof of what you've done. Probably something to consider for the future?====0 -

I have new hope now as my MP has taken up my case with Oliver Morley at DVLA.
I escalated my complaint from the CCRT team to Mr Morley, the Chief Executive @ DVLA and guess what..... The same person from the CCRT team, who told me I should/could escalate my complaint to Mr Morley, replied!!!
I am sure they do it just so you get fed up and give in, well they picked on the wrong one this time. and breath:mad:0 -
Just an up date, DVLA now say that under the "VERA" legislation they cannot do anything at all. I cannot find anything in that legislation that confirms their statement.
I keep telling them that they are not loosing anything as they had a road fund amount for the car for the month of June from me and the new owner. This new system is a "cash cow" for the DVLA, the public are being ripped off as in most cases the old and new owner pay for the same month unless they are lucky enough to sell/buy on the last day of the month. This would not happen under the old system as the tax just went with the car when sold. Wake up Britain it's another stealth tax!!!0 -
I found this and hope it will be helpful to anyone who has a dispute regarding posting an item through Royal Mail, especially when someone like DVLA claim non receipt of a document, such as my V5C/3......
1. The Universal Postal Union (of which Britain is a signatory) makes it clear that, in the UK, post becomes the property of the recipient at the moment it is committed to the Royal Mail.
2. The Interpretation Act 1997 section 7 makes it clear that a document sent by first-class post is deemed served. If the sender has proof of posting (or a witness). If he/she has no proof, he/she can swear an affidavit that the document was completed and posted.
Section 7 says, word for word.......
References to service by post.
Where an Act authorises or requires any document to be served by post (whether the expression “serve” or the expression “give” or “send” or any other expression is used) then, unless the contrary intention appears, the service is deemed to be effected by properly addressing, pre-paying and posting a letter containing the document and, unless the contrary is proved, to have been effected at the time at which the letter would be delivered in the ordinary course of post.
In other words according to the legislation, once you have posted it into Royal Mail it becomes the property of the person/organisation it is addressed to and is considered delivered from that point on.0 -

But you still need some sort of proof of when the thing was actually posted, don't you?0 -
All you need is the free 'Proof of Posting' receipt.
When it was actually delivered is of no importance, so signed for or tracked or guaranteed or whatever else options theree are is simply a waste of money.
It is 'deemed' to be delivered/served/returned or whatever word is applicable 2 days after the date you passed it over the PO counter - assuming you use 1st class post0 -

Hands up who thinks an MP would get involved over a disputed month of VED where there's no proof of posting?0 -

First you are correct, the amount was not £30, my mistake for rounding it up, it was £24.16.
Second, for you as a "money saver" an article from MC news in 2014. If the amounts quoted are anywhere near correct we should ALL be putting our hands up!!!
Official figures show that around 7 million used vehicles get a change of ownership each year. If, on average, each has half a month’s worth of VED remaining, that’s 3.5 million extra months of VED being paid each year. The equivalent of 291,666 years’ worth. If we estimate that the average annual VED cost per vehicle is £200 (a fair guess given the spread of rates), then that’s somewhere in the region of 58.3 million pounds windfall to the tax man. Every year. Not a bad haul, really.
I rest my case M'lud!!! :T
Oh and as for proof of posting read my earlier post, I think that is from The United Nations!0
