    Hi

I did a silly thing and crashed my car.

I was breathalised and was just over the limit which in Scotland is half that of the rest of the UK.

    I am an idiot!

However the lease company is still taking the lease fee each month and has taken £4,000 extra since the accident.

The car was written off by the insurer but they won't settle until my Court case has finalised which could be a total of 10 months since the accident.

Not only don't I have a car now, I am still paying for it.

Is there anything I can do please?

Drink drive limit in Scotland - 50mg per 100ml of blood
Drink drive limit in England - 80mp per 100ml of blood

    80/2 = 40

Since he said breath, why have you quoted blood?

Scotland it's 22 the rest of the U.K. Is 35 although prosecution starts at 40.

    Without being judgemental.

The lease company should not be out of pocket as a result of the situation.
It is a situation not of their making.
    Your contract is with them.
Therefore you owe them what you contractually agreed with them.

The fact that you no longer have the asset, or the value of the asset, is nothing to do with them.

The insurance company do not owe you any money as that is also in line with the contract you agreed with them.

Because one would assume the values would correlate.

It's a fair, and pretty correct assumption.

    50 is 62.5% of 80 (blood)

    22 is 62.8571% of 35 (breath)

Although I agree, assumption is not always a sound base for a statement, in this case it's damn near right.

Prosecution starts at 40 for breath, I don't know about Scotland so it maybe even closer.

Apart from when it only makes an !!! out of you.
  • Sounds like a troll to me.

If he isn't a troll, looks like he's either got to tell the lease company now or continue paying the monthly payments and decide what to do when they want their car back at the end of the time.

In any event, serves the OP right for drinking and driving.

....In any event, serves the OP right for drinking and driving.

It does appear to be trollish (DM perhaps) but, if genuine, then and I agree that it serves the OP right. He/she should know and observe the D&D laws where they live and where they drive.

Re D&D, we have a curious situation in the UK.

A driver who has had a few drinks and is under the England limit but over the Scotland driver can go from legal driver to criminal driver by driving over an unmarked border.

I'd be in favour of reducing the limit in England to that of Scotland and most of the rest of Europe.
