Lease Car Written off

I did a silly thing and crashed my car.

I was breathalised and was just over the limit which in Scotland is half that of the rest of the UK.

I am an idiot!

However the lease company is still taking the lease fee each month and has taken £4,000 extra since the accident.

The car was written off by the insurer but they won't settle until my Court case has finalised which could be a total of 10 months since the accident.

Not only don't I have a car now, I am still paying for it.

Is there anything I can do please?

    Read your car insurance policy - is the cover reduced if you crash while under the inflence of drink/drugs.

  • I may be sticking my neck on the line here but would hazard a guess that drink driving does not go hand in hand, Therefore due to your own stupidity thinking it is okay to do so would cause a slight issue with regards to insurance and car lease costs.


    Only yourself to blame really and it is right that you continue to pay for this as you need to learn a valuable lesson albeit an expensive one to.

    Only thing you can do is limit your losses, find out how to get out of the lease early. Ask how much the pre-accident value of the car was.

    If your policy is going to be honoured then you may be ok with paying for the mistake.

    If your insurers are not going to pay out then you are maybe better off going bankrupt and letting the lease company chase you for the money.

    Have you got any other secured or unsecured debts, rent or own your property?

    I did a quick google for you and couldn't find Admirals terms but it does list an exception under Bells' terms (virtually same company). So it doesn't look good - you could be liable for full cost.

    15. Drink and drugs clause

    If an accident happens whilst you or any person entitled to drive under Section 5 of your current Certificate of Motor Insurance:

    y is found to be over the prescribed limit for alcohol

    y is driving whilst unfit through drink or drugs, whether prescribed or otherwise

    y fails to provide a sample of breath, blood or urine when required to do so, without lawful reason

    No cover under the policy will be provided and instead, liability will be restricted to meeting the obligations as required by Road Traffic Law. In those circumstances, we will recover from you or the driver, all sums paid (including all legal costs), whether in settlement or under a court Judgment, of any claim arising from the accident.

    Which basically means you're paying if convicted.

    Yep. Learn a lesson and don't drink and drive.


    (And if that sounds harsh, sorry, but tough. Having been personally affected by the actions of an irresponsible driver who'd "only had a couple m'lud", I have precisely zero sympathy).

    No, it was just a Yaris. But it was the top-of-the-range model with the optional rear brakes.
