Council tax is a tax, it's not charged 'per tenancy'.
It's charged yearly, by banding (based on value)

FYI my partner has just informed me that when she was speaking to the council they said we are liable because of not being registered at the property?
It's a 2 story building with my partner and I on the 1st floor along with another tenant while there is one tenant above us on the 2nd floor.
The council said those who are registered on the 1st floor are the tenant opposite us and the tenant above us which clearly doesn't make sense?0 -

From what you now say, it appears this is a building with 6 quite separate flats. Each flat is a separate home, comprising just one or two tenants.
Each flat is therefore NOT an HMO.
An HMO is where numerous people/households share the same accomodation, which does not appear to be the case here.

In the building. How many flats are there? (do you go into any of the other flats? How many bathrooms and kitchens can you (and other people access)?
and what address do you have - where is your post delivered to?
Is it jus 36 A Street, or Flat 1, 36 A Street?

Do all these people live in the same 'flat'? ie they live together as a group and share the accomodation? eg they may each have their own bedroom, but share the kitchen YES SHARE, bathroomNO DON'T SHARE, loungeNO DON'T SHARE, front door etc?Could you just clarify if we mean front door to entire property or to doors leading to flats?

Post is just sent to the property rather then flat 1,2,3 etc.. plus property address if that makes sense.

There is 2 kitchens, 3 flats have it's own shower/bath 2 flats have to share shower/bath.
So yes 4 bathrooms 1 of which is shared between 2 flats.
2 Kitchens which 1 is shared between 4 flats 1 we have sole access to, however to make matters more confusing our landlord as confirmed to us a few times that should Brent make a visit our flat's "front door" would need removing and replacing into where our "flat" leads to our bedrooms as our property's kitchen is also meant to be a shared facility?

Ok so it is (Im about 85% sure) a HMO.
Therefore you LL is liable for the Council Tax.

Thanks again hopefully I can use all this and go to our landlord about the issue and try and resolve it now.
BTW would you or any other poster know what the landlord could provide as suitable proof that the council received council tax payments for our flat?0
