UKPC appeal

Personally, I would not waste my time taking this disreputable company seriously.
Does anyone think that, with an almost certainly guilty verdict, at least from reputable bodies, this company has a future? You never know how far you can go until you go too far.0 -
Ok brilliant, I think I've made all the recommended changes. I've taken out the part about the sign being lit up by headlights, added the extra paragraph to the Aziz test, and adjusted the Consumer Contracts Regulations. Now I guess the question is, do I submit straight away or wait until closer to my POPLA code expiring? I must admit I am still fearful of a rejection, because I can't afford the £60 let alone £100.0

Submit it now and wait for the evidence pack if they contest it, then come back here as you get a chance to add more comments then, a final word which can be vital.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

when you did the appeal to them
a: did you name yourself as the driver at the time
b: did you give your full NAME and ADDRESS
c: was it done by mail or email
and taken from another posting about UKPC tonight

Yes. Exactamundo, it's always been the case which is why the advice is written the way it is in the NEWBIES thread = slam dunk win, no keeper liability if the PPC don't jump through the hoops of all 3 conditions explained by nigelbb.
CM , why bother with the appeal then , if they cannot get the info from the DVLA they are stuffed , are they not?0 -

Whilst I can't recall on the original appeal form if I had to tick if I was the keeper or the driver, I know I have stupidly referred to 'me' - and don't get me started on the naivety of appealing in the first place ha. Lesson learnt. I am planning to submit my appeal to POPLA this evening, do we know how long their decisions typically take? I know the POPLA thread shows a lot of positive outcomes, but do you think negative outcomes typically don't get posted?
Just noticed that on the POPLA website it says 'Will the parking charge increase if I lose my appeal? The parking charge will not increase if you lose your appeal, although the early payment discount period will have passed by the time your appeal has been considered.'.
UKPC state, 'Please note that if you wish to appeal to POPLA, you will lose the right to pay the charge at the discounted rate of £60 , and should POPLA's decision not go in your favour you will be required to pay the full amount of £100.'
Surely this is incorrect, as UKPC have given me 35 days from the date of their first letter to pay £60 - if POPLA were to reject my appeal within 35 days of that letter, I should still pay £60?0 -
No, have faith! We've not lost one in ages, but not many decisions have come from new POPLA yet (started in October, only a handful known plus plenty of PPCs dropping out).
Takes maybe 3 or 4 weeks to get your copy of the evidence (if UKPC bother to send you a copy). If POPLA say by email that they've got the evidence but you haven't, email the BPA to complain about UKPC as they've done this to some cases I know about:
aos@britishparking.co.uk
Then maybe another 3 or 4 weeks after you've added your comments to POPLA about the evidence pack, until a decision - but that's a guess and I think they are starting to get quite a backlog already. This side of Christmas is unlikely, unless UKPC drop out.
You won't be paying UKPC a penny. Take you eye off those discount deadlines and relax and enjoy the ride.

Thank you again Coupon-mad. I've edited my last post to add an extra something I noticed, I don't know if you think that's something worth mentioning to POPLA? (Probably not given the timescales you've given, although it is another example of UKPC making up their own rules)0

The matter of the card surcharges is fo Trading Standards.
I was surcharged recently by a hotel in Blackpool, complained to TS, and the amount was refunded.
UKPC are in so much trouble that the last thing they want is TS breathing down their neck, so complain, complain, complain. You never know how far you can go until you go too far.0 -
Anybody know if they're still banned from obtaining driver details ?
Thanks0
