In need of some advice. The driver of a vehicle has received a pcn Re parking in the above car park. The driver was not aware that this car park was shared between two companies. They saw a space at the back of the car park which was ideal as they had a push chair with them so was perfect as no space next to the car. They entered the details on the machine in the store as instructed. The driver saw no signs stating that there were specific areas for parking in the car park. Then arrives the pcn, photos have been taken by what looks like a CCTV not sure how I would know if it was anpr?! Driver was parked for less than 10minutes. Is there anything should or shouldn't be done with this. Any advice would be greatly appreciated only just received through the post so have 6 days left to get reduce rate. Thank you

read the newbies sticky thread , appeal using the template letter, complain to the landowner and try to get a cancellation
bear in mind NPE use the IAS so read what is said about that process too (if its this lot (Northwest Parking Enforcement Ltd)
if its this NPE http://www.parkingprotection.co.uk , then its the BPA and popla and the BPA site says they dont use ANPR
if anpr was used the NTK has to arrive by post within 14 days, but these photos are likely to be handheld camera ones or cctv ones, not anpr
if they use ANPR, it will say so on the signage
if it says 6 days to pay the reduced rate, it sounds like an IAS member0 -
Well apprantly the driver shouldn't of parked there but I will be checking this as they said no signs to be seen near the area! Would contact the shop but they won't take responsibility for it! Had a look at the newbies thread so seen letter etc. Not sure if the best is to ignore or appeal?! Seems ridiculous for less than 10mins0

people who ignore in england or wales (like this one) could be taken to court in the next 6 years and held accountable for it, even if they are not the driver
so ignore it at your own risk, but dont think the "I was not the driver your honour" is going to work, not if the PPC followed POFA 20120 -
Maybe worth checking what the sign says Re anpr?! The photos weren't taken by handheld as they are taken high up?! The company is parking protection so they seem to have various different names?! Surely this could be something if the signs (if any) state all names?!.0

if you feel there are grounds for appeal then you should go down that route and try to sort it out, as RK you are held responsible for this, unless you name the driver and let them deal with it because they were responsible
that PPC says no ANPR on the BPA website , so is likely to be by other means

Thank you for the help. Ah that's interesting, they have said I only have 14days to appeal took them over a week to send it out so not giving me much time. Wonder where I stand if they say anpr of though they aren't registered to use one!.0

if its high up I suspect its CCTV myself , if it was anpr the photos would be dark with the number plate highlighted for clarity and a BPA member would have to register that method with the BPA
I doubt it matters at this stage, its at the next appeal stage where you get your ducks in a row and use signage , no landowner contract and other appeal points to try to win your case, so pointless discussing the signage until you have pictures of it
you need to know whose signage covers the aldi part of that car park, and whose signage covers the other business on that car park
if the car park is split bwtween 2 parking companies then its likely that the store they went to has no jurisdiction over the other half of that car park , they parked in the area for one ppc and went to the store where the other half is and controlled by a different ppc, as aldi dont usually use this ppc anyway
there are many split car parks like this, hence why any complaint goes to the landowner, not the retailer
I can understand an IPC member only allowing up to 21 days to appeal , so 15 + 6 seemed correct, but a BPA member has to allow 28 days for an appeal , so any issues like this would be put into a popla appeal if they dont cancel at the initial appeal stage0 -

you could name the driver and be done with it, that is one option and is allowed by POFA 2012
you could appeal it and take your chances as RK
or you could pay it (which we rarely recommend)
you could (and should) complain to the landowner and demand the charge is cancelled0 -
So I'm best to appeal and complain to land owner?0
