PCN with wrong station name

Options
Hi guys, a Penalty Charge Notice was recently placed on my car at Dorking Station - typically unfairly, not being able to park in a bay, despite having paid for a season ticket in good faith, the driver tucked the car away, not obstructing anyone... but I digress.

The odd thing about the PCN is that it states the location as Cheam/Main (presumably the setting on their device that would normally designate Cheam station).

So I guess that's a cast iron appeal win right there? In which case, is there a shortcut to getting them to rescind in, or should I simply pursue the appeal in the usual way (i.e. as per all the excellent advice on this board!).

Fair to say they're going to struggle to prove my car was in Cheam!

Many thanks in advance.

  • wait for the NTK coming with the wrong location on it , they could just be hoping you contact them , therefore saving £2.50 Dvla fee , and incriminating yourself.

is there any mention of railway bylaws on the signage or ticket? ,

Who issued the ticket? You use the term "penalty charge notice" is that the exact wording on the notice and if so is there any mention of the railway byelaws?
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com
  • there is another posting regarding the same station tonight https://forums.moneysavingexpert.com/discussion/5356701

it mentions Meteor / Vinci hence why I also asked about bylaws ,

    Same poster Freddy.

Duplicate posting will ensure a diluted response from regulars - not helpful to the OP.

@OP - please PM Crabman, Forum Guide and ask that your two threads are merged. Please keep everything on that one thread afterwards.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Hi all, thanks for the responses. Will check out the wording and come back.

FYI the other thread is indeed me and it is the same station, but I kept them separate as it's a different PCN (that one DID say Dorking!) and so a different narrative. Was trying to keep it simple - hope haven't achieved the opposite?

Thanks all - now at home to check the wording. So... with no further ado... it's definitely described specifically as a "penalty charge notice" and there's no mention of bylaws on the PCN slip. Will have to check the signs in the car park for any mention there.

What's the significance of the mention of bylaws? Thanks again.
  • coz if its a by law offence its different to private parking , and if there are any signs relating to bylaws they cannot issue a "parking" ticket.

lots of other things as well,

    2 things

    1: date of ticket
2: have you replied to the scum yet

and please check the car park , armed with a camera , photo the signage and post it up , look for any other (possibly older) signs saying bylaws
