which then brings the problem of buying a vehicle with a missing V5 , and awaiting the 6 weeks till a new one is sent , and you can get the vehicle in your own name and tax or sorn it ,

I could understand the common sence saying that you cannot park it on aldi,s carpark , however there are millions of rented houses about with driveways

Find one to park it on then, sadly yours isn't a driveway.
  • yes , I have agreed with you on my land situation , its just clarifying your comments on the ownership of land v parker

mine is NOT a communal bay , there are no communal parkings on the estate , just street parking + plus several houses (I do not know if private or rented) that have had driveways installed

this is why I am trying to define "Parking bay provided for housing association homes"

the reason for the private parking Co use is that when the previous owner stopped using her car , someone else started working on wrecks at the location , and the police/dvla were not interested in removing them , so the PPC method was used (clamping/towing days )

The DVLA can remove unlicensed vehicles from any place which is not:

'(a)Any place which is within the curtilage of, or in the vicinity of, a dwelling-house, mobile home or houseboat and which is normally enjoyed with it, or
(b)Any place which is within the curtilage of, or in the vicinity of, a building consisting entirely (apart from common parts) of two or more dwellings and which is normally enjoyed only by the occupiers of one or more of those dwellings.'

Sch. 2A, Vehicles Excise & Registration Act 1994, as amended by Sch. 45, Finance Act 2008.
  • detached house = safe from DVLA

semi detached house with drive in-between houses (shared ownership) = DVLA tow

    See above DVLA cannot tow.

sorry my bad , I misread that

    however

"'(a)Any place which is within the curtilage of, or in the vicinity of, a dwelling-house, mobile home or houseboat and which is normally enjoyed with it"

as per my previous posting , and photo of location the words in the vicinity of and normally enjoyed with it" intrigue me .

    vicinity of , = definatly

normally enjoyed with it , = yes , I have to pay the housing assoc for use of the land , just as I have to pay for the rent , this patch of land cannot be used by anyone else , and is for my sole use

Well if you exclusively pay for this land on a separate contract you may have an argument, however if it's just part of your rent it's a housing association parking bay.
  • yes there is a separate charge I have to pay each year (instead of weekly) to have exclusive use of the land , NO other permits will be issued for the land , and it must be clearly displayed whilst parked there.

the reason for asking , last year I had an operation on my hand and unable to drive for almost 2 mths , so sorned the car , over the previous yrs I have exclusively used my motorcyles(s) for several mths in the summer mths and simply let the MOT and tax run out and sorned , until needed later in the year .

I intend to do this next year and for the foreseeable future ,
