    To my knowledge (old) POPLA never allowed a retrospective appeal beyond the deadline date - OK, a day or two out, but never weeks. Whether new POPLA will agree is extremely unlikely, but unless you ask........ But I suspect you'd be going down a blind alley.

    DRP nor any PPC will return your money voluntarily. The one way you might have a slim chance is via a Money Claim On Line (MCOL) through the Small Claims Court, but it will need a significant amount of research and work to gear yourself up in order to take a chance at the lottery that is the Small Claims Court. And Beavis will make the job harder for you.

    MSE is aware that "first posters" do get the bullying responses you got from those who simply reared up at you, which is why you get a special "newbie" badge to try and get better welcomes for new posters.


    As you have seen the sentiments of the badge get ignored by certain individuals.


    Those that have been around a while know the bullies and who to ignore, but newbies don't necessarily have that advantage.


    (You say you have been around a while before your maiden post, so hopefully you will have known what to expect, and recognised those who were unpleasant to you or about you, and can ignore them as well as those who were downright rude to you)

    the original PPCs name has now been edited out , however I can see that it refers to a blue badge charge
    I would suggest the Op starts the process to apply pressure to the car park owner and the PPC with regard to the equalities act

    I read this thread near the beginning and partway through and have re-read it too

    firstly I congratulate the OP for having the decency to alter it and put right any inaccuracies along the way, especially post #1 and the title header too

    in my opinion , at no time has the OP divulged the PPC despite being asked the details in one of the early replies, all we know is that it was a BPA member because there is a mention of popla

    its probably futile trying to chase DRP and get a refund, highly unlikely to succeed, even in small claims court

    if PPA could not help as 4cr seems to indicate, then the refund is in order , shame the popla code had expired and shame that the email bounced back too, its a comms error and providing a refund is due then it should be paid

    M Lewis should not have been mentioned, totally irrelevant , sorry to say

    I do agree that if this space was occupied by a legitimately disabled and protected person, then the OP should consider a counter claim under the EA2010

    it was on the news just the other night that too many problems occur that should not since the DDA and EA2010 came into force , with one disabled campaigner privately suing many businesses and utilities etc

    if a disabled persons rights were infringed then they should consider the small claims court process to get redress, no doubt about it
  • I can confirm the OP has been refunded and an email sent and I also made the suggestion that he tackles the retailer in question with a view for seeking recompense/ damages for discrimination.

    I will be happy to draft a letter for them in that respect (that is something I omitted from an email).
  • if it can be proved that the equality act was in force , and the OP actually informed them , could charges not only include the retailer , the PPC and the BPA (popla for failing to act) , and then go on to reclaiming the monies paid to DR+?
  • Just to add to CENSTE's thread: I had a similar experience - came to Private Parking Ticket Appeals (parkingcowboys.co.uk/appeal-service) via parkingcowboys.co.uk (if one has nothing to do with the other, why are they one the same website???), paid £19, outlined my case and asked for advice. Apart from an automated order confirmation (dated 20 June 2016) I have heard absolutely nothing, despite emailing them since then.
    I got on to the parkingcowboys website after reading up on private parking tickets on MSE (at the risk of being shouted at: I wouldn't have invested the money if I hadn't trusted MSE in the first place). One lives and learns...
