    If the op is for real then his defence could be that he was not parked on Hythe Road at any time, so it was not his vehicle that was ticketed.

    He also needs to know the issue dates of the tickets as some may well have been issued after UKPC had their access to the DVLA curtailed and as such, are not chaseable.

    As for trespass, they guy works for a company and parks in it's carpark. He has a legal right to be there so UKPC would have a hard time proving otherwise.

    and to finish off-

    Well, it didn't take too long to come up with something that seems to fit the location.

    I believe that the OP is talking about a location just north of the junction of Salter Street and Hythe Road in White City. The area is pretty much dominated by a large second-hand car dealership

    If you explore the area around the junction shown in the GSV link above you will see a number of BPA style parking signs and throughout the length of the northern section of Salter Street there are UKPC signs displayed on walls - not that they are very large but zoom in on them and it is clear that they start with the words "No Unauthorised Parking".

    Other signs on the buildings - particularly to the eastern side - make it clear that these are owned/operated by the same large used car dealership and that their main site backs onto Hythe Road - which could well be where the confusion over location has arisen.

    The OP openly accepts that he is not entitled to a permit and that in order to park in the area he needs one, he has therefore parked in flagrant contravention of the No Unauthorised Parking signs. Boiling that down to gravy he was an intentional and persistent trespasser.

    That said, he cannot reasonably be pursued for breaches of contract if UKPC submit that by parking as a trespasser he is liable to one of their charges. That is a legal nonsense.

    As suggested earlier it hinges on whether UKPC have sufficient interest in the land to act on their own account in an action in trespass or propose to act on behalf of the landholder and are duly authorised to do so.

    This begs a number of other questions. If the landholder's interest in the land was being so damaged or endangered by the actions of the OP why didn't they act far earlier to prevent such endangerment/damage and thereby minimise their losses? If I have read the OP correctly then he was only banned from the car parks after he had been issued with 17-19 PCN's. That hardly represents acting swiftly to protect one's interests and, I suggest, hobbles their claim. We should also bear in mind that the OP has not given us any clue about any action - warnings etc - that may have been used before he was actually banned (I appreciate that it seems the ban was issued verbally).

    Given the foregoing I'd suggest that the OP looks to negotiate with UKPC/the landholder (his employer?) and makes an offer of a nominal sum per PCN (such as might be properly due in trespass). He is not going to win any brownie points whatsoever with a judge regardless of how poorly or otherwise UKPC's case is constructed and were he to be as unforthcoming in court as he has been here (drip-feeding is not the way to get coherent advice) then it might end up in tears.

    If the OP doesn't now post up a suitably redacted copy of the Particulars of Claim then we'll reasonably be at liberty to conclude this is a wind-up. It will be interesting to see who the claimant is. It will also be interesting to see who actually issued the PCN's -is it a self-ticketing operation for example? If it is then there is even less excuse for the landholder not having acted earlier to protect their interests.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    I agree that that its easy to question why he continued to park there, but I think now that he has, we should advise him rather than be suspicious of the story.


    I have started my thread and I have two letter from SCSs for a total of £3600. Its frightening. im very scared and worried and its genuine.


    Like Mr Sparrow, Ive turned up here for advice and help and I only feel its fair to offer him the benefit of the doubt.


    I have my own thread with my case and don't want to confuse both cases.

    I too agree that OP should be given the benefit of the doubt. When I first started contributing to this board I too was accused by several of the regulars of being a PPC stooge.
    You never know how far you can go until you go too far.
  • I do hope you are right but I don't believe it. 2 new posters, both large amounts, both UKPC, both changed cars around July, both ignored until too late. Sorry.

    Because I included a link to this thread in their's. There is a significant difference between the two OP's. We have had sight of aworrieddriver's LBA's.
