Voluntary Termination

Hi All,

I am hoping someone can help here.

I have given a car back on Voluntary Termination about a month ago and have today received a repair letter from the Finance company advising of what we need to pay for which I presume they determine as above Wear and Tear. It Lists

L Front Hub Cap Scuff - £20
R Front Hub Cap Scuff - £20
R Rear Hub Cap Scuff - £41.50
Front Bumper Scuff - £101.50
Roof Dent - £48.00

Now this is where I need help. When they originally came to inspect the car the guy got me to sign a sheet which listed all the details of the car and also there was a part of the form which had diagrams of a car where they had marked issue.

The only thing marked on this form is

Accident Damage on Rear right Bumper which is on the repair form they sent but they are not charging me for this as they have marked it as poor repair

Scratch on Rear Right Bumper panel which again is on repair form they sent but they are not charging me for this as they have marked it as poor repair

So where do I stand in terms of I signed a form when they were here agreeing to the 2 marks above but they did not mark any of the stuff they are charging me for?

    They agreed the marks are there, not that they accept the marks should be there for a vehicle of that age/mileage.

    If you do not agree with the charges then make a complaint.

    I have now made a complaint however surely if I have signed something from them agreeing there are only 2 marks there and on the repair sheet those 2 marks state poor repair but they are not charging me for it I should not have to pay for anything else they have now stuck on the repair sheet after they have taken it away as they did not state these marks on the sheet I signed?

    So after several weeks and sending over the inspection sheet I have now received a letter stating they are willing to eliminate all repair costs as it was not on the original inspection sheet.

    However it then states all I have to pay is nearly £300 quid for the collection of the vehicle in relation to when it was picked up as it was picked up by a 3rd party company called Anglia.

    Now I checked the Inspection sheet I signed and indeed it was collected by Anglia that collected it.

    However when I rang for it to be collected it was the company Manheim who I rang as per the agreement and they did not mention anything about sending a 3rd party company and did not advise me there would be any charge. Neither did the Inspection sheet I signed or the people that came to collect advise me that there is a charge for collection.

    Also the final charge sheet that Money way sent only listed the repairs and no other charges and now that the repair charges have been waived this is the first time I knew of this collection charge.

    I am ringing them tomorrow but does anyone know where I stand with this as have never been informed of any charge

    Check T&C's but sounds like they waived one fee and made another one up to try and get the money anyway.

    They can not charge you for collection of the vehicle.

    They have 2 options in this regard. Either they collect the vehicle from you, at their expense, or, they ask you to drop the vehicle at a place within "reasonable" distance from the registered address of the vehicle (30ish miles is deemed reasonable i believe).

    Do not pay the £300. They are just trying it on to get more money out of you.

    Also, for what its worth, remember the old saying.
    "a verbal agreement isnt worth the paper its written on"

    Communicate with them via email, or via post. then you have a record of what has been said, and they cant deny anything agreed. remember, they want your money. The ball is in your court here, as you dont have to give them any of your money. there is no rush, so dont waste the phonecall. Email if you prefer, or post if you want to drag it out.

  • we VT'd a car recently and 3 guys from Manheim turned up to collect it (we were charged £70 or had the option to drop off at the nearest Manheim location 80 miles away)

    Anyway, we did the walk around and agreed the 'damage' - a stone chip on the bonnet, a chip above the rear light and an alloy scuff. I took photos of all highlighted.
    This was just a record of the damage not if any of it exceeded wear and tear.

    The bizarre thing was that the bottom of the form had a disclaimer stating that the vehicle would be taken to a well lit inspection bay for a more thorough examination.

    This would obviously occur without me being present. What is the point of going over the detailed inspection outside my house and signing documentation which agrees damage if i can be overridden by whatever they say when it gets back to the auction house?

    Our inspection sheet did not have any disclaimer but I have realised that Manheim that did not carry out the inspection and sent the 3rd party however I still got the damage waived when Manheim finally inspected it as I only signed the piece of paper on the initial inspection and not the one Manheim did around closed doors
  • So really after some advice again as I think this company are really tying to rip me off.

    Since they stated they would charge me nearly £300 for collecting the car which they never stated to me beforehand they have now said they are entitled to charge as it took longer than usual to pick the car up from me as I was waiting for a V5. However I have complained and the most recent is I have received a letter from them stating the charges and to me this is totally wrong but wanted to check on here.

    So not only does this letter state 3 separate collection charges and not sure what these are, it also states monthly charges for the car which when I rang and asked if I would carry on paying for the car once the VT was accepted and processing they said no you would not. Also I noticed even after the write off of the agreement they have still charged me every month right up until last month and surely this cannot be right as I gave the car back way before Christmas.
