    If you send it "Signed For" and she doesn't sign for it then the letter won't be delivered, in other words your LBA will not be served.

    With 1st class post it just goes through the letter box and is deemed served 2 working days after posting.

    One it will cost more to send recorded or signed for and secondly she may refuse to pick it up. The best bet is to go to a post office and queue up and get the postage from the counter staff. Ask them and they will give you proof of posting for free (ask before they process the item as they get annoyed if they do the postage, put it in the postal bin behind the counter and then have to retrieve it to fill out the proof of posting form). Keep this proof of posting form. It is asumex in court that if you have proof of posting that the letter has arrived. You don't have to prove it was delivered but only that you sent it. Actually doing a small claim is dead easy, you can do it online in minutes ( I'm not sure on the cost but its not hundreds of pounds or anything).

  • Morning everyone,

    Just to let you know that i have sent my landlord above letter, now she is furious sending me text saying that my sister is solicitor who advised me not to pay because i don't owe any money etc and would like this to be settled in court.

    And then an hour later another text came which says " if you do win this case which you might then i won't be able to pay that amount Lee (her husband and also landlord) just gone bankrupt but i will pay it monthly at £ 5 a month"

    Now i have no clue at this point what to do as she showed her intention what she will do, will court consider that she had planned this before ?

    Please advise

    Do not respond to her text messages. Do keep them just in case you need them as evidence further down the line though.

    You've sent a Letter Before Action, she still hasn't returned your deposit so now it's time to take Action. File a Money Claim Online and take her to court for the return of your money.

A specialist in housing law?

    Dear X, please can you keep all correspondence written in letter form and not text me in the future. I have clearly stated my intention, if you wish to make a settlement offer, please do so in writing with-in the allotted timeframe.

    Then ignore all future texts. She is trying to gather evidence and scare you (solicitor who will work for free and £5 a month payments)

    I am not sending her any messages, i am sure she will offer me settlement. but after all the will I be happy for £ 150 i don't so despite her calling me that i live like a pig etc

    I am just reading how to make claim on above money claim website, there are different cost against different amount my questions are:
    1. do i have to wait 7 days till fill out the form.
    2. LL owe £150 but someone mention she could be liable for 3 x 475 = 1425 so should i fill out for £150 or £1425.

    Mcol is for money owed not for the penalty. So just £150.
