    This case does have aspects which make it distinguishable from Beavis and contrary to Parking Eye's standard terms of engagement with their clients... However, I am not prepared to put this on an open forum.

  • Guys I've just been to the hotel and the manager says he's going to have it recinded......lights in the car park weren't working and I was a patron at the bar etc etc! What does this mean? Do I still have to do a defence.....the claim form is dated 12 Oct....think that means it has to be in at 4pm today......is that right? £100.....can take all you guys for a Guinness?!

    By the way your credit rating will not be affected if you pay any judgment (whether determined in court ) or from a default judgment within 28 days.....

    The date of service is different to the date of issue!

    The hotel are unlikely to get this sorted before your deadline!

    Put in a defence before the deadline irrespective of this new development

    It means that - given this is PE - the claim will probably still continue, but if you can get something in writing from the Hotel (who are, I assume, PE's principal) to say that they do not wish for PE to proceed with the court claim, then it does give you another defence point - that PE have no cause of action, and are not acting in accordance with the Principal's wishes by pursuing this.

    Be prepared for PE to tell the Hotel that it's too late for them to intervene. This is in fact b*ll*cks, they can intervene at any time they like (Sadler v Leigh).

    (2) Except where paragraph (4) applies, a default judgment on a claim for a specified amount of money obtained on the filing of a request, will be judgment for the amount of the claim (less any payments made) and costs –
    (a) to be paid by the date or at the rate specified in the request for judgment; or
    (b) if none is specified, immediately.
    (Interest may be included in a default judgment obtained by filing a request if the conditions set out in Rule 12.6 are satisfied)
    (Rule 45.4 provides for fixed costs on the entry of a default judgment)

    We were discussing when a CCJ will affect your credit status (which is not till it's registered irrespective of when the judgement says it should be paid by

    To prevent a CCJ being registered (even if the claimant has got "immediate" payment in the judgement) it must be paid in full within 30 days.

    You need this in writing....

    As per my first post.....

    Your defence needs to be with the court by the 14th !

    You need to still file this defence

    Start the claim with the following:

    It is requested that the claim be struck out as the Claimant has no reasonable grounds for pursuing this matter further on the basis that the principal has ordered that the charge be dropped.

    And submit the bullet points previously supplied to you.
