    It's no longer a lottery if you do nothing. It's a dead cert ... for the claimant.

  • It's the bulk centre. Northampton. So I have to prepare my defence soon. The issue date is 12 Oct and I acknowledged on the 29th. This gives me a few days by my calculations. I will be working on it tomorrow. Any advice on how to do it online? Basically just want to go along the lines of I was a paying customer at the bar, the signage was inadequate. There was a sign saying I need to input my details at the reception but I wasn't checking in and there was no sign to input my reg at the bar. Any other suggestions? Don't really understand this adr by popla. I still might try contacting parking eye and the hotel but I imagine I'll be having to go to court soon anyhow. Thanks. Much appreciated :)

    Have you complained to the hotel, written bad things on TripAdviser?

    i parked up in a hotel at gatwick in the summer and had a drink. I few weeks later i got a ticket from parking eye. There was no barrier or anything. It was at night, i didnt even see the sign when i drove in.

    It's not. It will be your local court.
    What are we gonna do now after the beavis result? It's gonna be open season now! Should just pay up before it escalates?
    It's already escalated as far as it goes. But you could consider now making an offer as well as complaining to the Hotel Chain Top Banana. NOW!!

    Your case differs from Beavis but you'd have to start your defence my clearly distinguishing your case from that one because of the significant issues and facts applicable.

    By my calculations your defence has to be received by the court by the 14th !

    Looks like you may be heading for an automatic default judgment.....

    You need to get a defence in pretty sharpish - first priority....

    Contacting the hotel and Parking eye now is secondary.

    You will lose the case if you put just your points above.

    You won't get an automatic default judgement as long as your initial defence is sent in to arrive before the deadline.


    At this stage you don't need to send in your full defence.


    A simple defence along the lines of "the defendant denies owing the claimant any money" is all that is needed.


    If the claimant wants to proceed, then your case becomes a "defended case" and you will then get more docs from the court when you can then submit your fuller defence.


    You have weeks till that will be needed.

    Really, how many court claims have you done for Parking Eye or any other parking company?

    You certainly are wrong. It is not necessary to give a full defence within 14 days (or 28 if you use the acknowledgement).

    a) successfully challenged at either first appeal or POPLA?
    b) How many court claims have you seen or dealt with in respect of parking cases?.
    c) what experience have negotiating lower settlements for badly defended court claims?
