Parking eye court claim form

Hi, I'm a bit miffed, i parked up in a hotel at gatwick in the summer and had a drink. I few weeks later i got a ticket from parking eye. There was no barrier or anything. It was at night, i didnt even see the sign when i drove in. Now i just ignored them and hoped they would go away and now a few months down the line ive received a court claim form, not with a summons date but where i need to admit or defend the claim through acknowledgement of service. what should i do? should i just leave it and hope they wont take me to court or get one of the companies involved that deal with parking eye to try and get me off for £18 or deal with it myself. not really too fussed about CCJ's and credit rating in this day and age (lthough thats probably not the right attitude) but maybe in a few years time don't want the cops knocking on my door where its escalated into something more serious - can this happen? i mean its private land and surely its not a police issue. any advise greatly welcomed :)

    You need to acknowledge the papers to save yourself the pain of a default judgement.

    Then, get stuck into the Newbies Thread. Start at post 5 which gives you advice on how to take this forward from here.

    PS, cops won't be coming knocking!

    You must not ignore this - if you do, you will be on the wrong end of a default judgment. Parking Eye are the most litigious PPC of them all and file thousands of court claims each year. This is going to County court.

    What you need to do first is go through the NEWBIES thread at the top of the forum and get an understanding of whats going on.

    Pay particular attention to Post #5 - the one dealing with small claims, as this is what you face.
    When you have, come back here and ask any further questions you may have.

    I dont think any company will take on your court case for £18

    they do get involved for that sum at the popla stage but you are wayyyyy beyond that due to ignoring the letters

    as this is at court stage then you may be able to get a defence drafted for a fee , but they wont take it all on board for such a low figure as £18 , not in my opinion

    this would have been easier to deal with when you first got the pcn in the post, now you have a tiger by the tail
  • Does anyone know when the beavis result is out? I would have tried to have done something about it if I'd have known of the escalation....things like this are stressful enough.....having to justify yourself.

    Acknowledge the claim on MCOL urgently (NO DEFENCE IN THAT SUBMISSION) then that buys you an extra 14 days to put a defence together. Read the Newbies thread about court stage/defences and also the Parking Prankster's blog and guide.

    Yes you acknowledge online. Who cares how much they've paid, not much, just a court fee. You want to defend this.

    lol , I meant take it on and write a defence and deal with the whole thing on behalf of the client, not for £18

    I do agree that this "company" will write a defence for that sum of money, but the defendant still has to deal with the court proceedings , they cannot sit on their backside and let someone else do all of the the work for a mere £18

    the OP seems to think he can dump it all on somebody else for the small charge of £18 , less than 3 hours at gross minimum wage, instead of doing it himself

    depends on the defense you were asked to sort out, or the fact that you could ask the court for ADR by popla (which is what should have happened months ago)

    ADR is a big issue at the moment so I would try to have a defense based on signage , no locus standii (no landowner contract) , any NTK flaws etc , then ask for ADR by the Ombudsman Service (popla) which you will ask to be binding on both parties

    PPA can write that defense if they take it on, but you will still have to deal with the court (not PPA)

    ps:- it has already escalated when the court papers were served, so I hope you have been sorting it out over the last fortnight because I get the impression that you are doing nothing about it, which is fatal in this court case lottery
