Unfortunately, the only likely scenario of being prosecuted for knowingly riding a de-restricted moped would be if it was examined after a serious accident.
Traffic officers otherwise warn the rider that they suspect it's been modified and to get it looked at but unless they were speeding will usually walk away as there simply isn't the resource to seize and inspect. Even if they're speeding, that's all they'll be done for.
TBH, it's easier and cheaper to simply do the CBTChange is inevitable, except from a vending machine.0
