Cheque Help needed

Hi

i have sent someone a cheque for something and they are saying that they have not recieved it.

How to i find out they are telling the truth and that they have not cashed it and want another lot of money from me?

Its a company cheque from me to a personal bank account

    All you have to do is tell your bank it's been lost in the post and ask them to put a stop on it.

    This will be free, they will first check that it hasn't been presented, then (after they've confirmed that) you can write another one.

    In the meantime, tell your payee that's what you're doing, they should understand.

    Its been a while - about 3/4 weeks since the cheque was sent, so no way of stopping it.

    Gave them the benefit of the doubt due to the postal strike

    Have a feeling i have been scammed, can my bank trace the cheque even after 4 weeks?

    You may be misunderstanding the usage of the word 'stop' here.

    What happens is that your bank 'stop' it being presented to your account. So, even if the cheque were later found and presented, it would be returned to the payee without being deducted from your bank account.

    You say it's a business bank a/c, this is normal practice for a business writing lots of cheques, these things happen and banks are quite used to it. They will understand if you just tell them what I said in my first post. Make sure to say it's lost in the post, as if they thought you were doing it for any other reason (like changing your mind about paying for something) they may charge you.

    Tell the payee what you are doing, then they will understand the reason for the delay till the bank confirm it's stopped.

    If the cheque has already been cashed then the bank will tell you that, so you can go back to the seller and tell them.

    If you have details of the cheque (cheque number and amount) you can phone the Bank to ask if it has been presented already. Alternatively if you have access to online banking you can check there. A third option is to look at your Bank statements. If it doesn't appear in any of the three cases then it's safe to say it hasn't been cashed.

    You then phone your bank and ask them to stop the cheque. Tell them it has been lost in the post so hopefully your Bank then won't charge you for stopping the cheque and you can send a new cheque to the person who says they haven't had your old one!

    If you find they have already cashed the cheque then come and ask for advice on the ebay board (see my signature). Basically though a cheque once presented cannot be stopped, so you then have to fall back onto the legal system to try and recover funds. Unfortunately ebay no longer carry any protection for buyers using cheques, hence me suggesting legal processes.

    However, if you want me to take a look at the seller history and see whether there is any reason to suggest they might be a problem, then just pm me the seller's user id.

    If you buy goods by cheque and the seller does not deliver then yes you need to go through small claims.

    Banks can easily see if your cheque has been presented, but like the other responses it is often quicker for you to do this yourself if you have access to online banking.

    I'm still happy to look at the seller for you if you wish.
