My rights regarding faulty carpet

I bought a carpet from Carpet Right to include, underlay and fitting, once fitted the fitter noticed a fault in it which meant there was a visible line down the middle. They then came out again a few weeks later and fitted a new carpet which again had a line down the middle. A week later a Carpet Right manager came to visit to check and took photos and sent it to the manufacturer who have admitted it is a manufacturing fault. The manufacturer no longer make the carpet so Carpet Right say I should come in and choose another carpet style. I don’t think they have any other carpets I like, am I entitled to a complete refund seeing as they cannot provide me with what I ordered? If so can I just keep the existing faulty carpet?

  • You would be entitled to reject the carpet and get a refund - however in terms of keeping the carpet that would be down to carpet right. You're not entitled to it by right.

    I forgot to say that Carpet Right took up my old carpet and cut it up prior to fitting the new carpet. Does this in any way affect that I am not entitled to the faulty carpet by right? Afterall I will be worse off if I get a refund as I will have no carpet whatsoever.

    It doesn't matter that your old carpet was taken up and removed. If you asked for it to be fitted then you also wanted it to be taken up as it had no value.

    It's unlikely they'll want the carpet back but they do have a right to it.

    You'll only get the cost of the carpet refunded though. The fitting, underlay and anything else required will not be refunded.

    I'd try and find something else that they have in stock as they will offer to fit that for free using your existing underlay.

    You still need a new carpet regardless. So you can either buy another with the refund or since you aren't actually that bothered with the fault why not just ask for a suitable discount?

    Doesn't seem like that's what the OP wants, they want a full refund and keep the carpet - using the 'consumer rights' section as the 'greedy b***ers' section as a lot of posters do.

    I had a carpet off them in my old house that had a defect line through it, the fitter noticed it on the day and called the shop. I was offered a new carpet (and a two week wait) or to keep the one with the line for a discounted price. I can't remember exactly how much I had back but as the line would be mostly hidden by the sofa anyway I took the partial refund.

    They would possibly offer you something similar if you asked.

  • Thanks all. It isnt a pole mark, it is a fault and Carpet Right have been to look at it and agreed.

    OK so I am being a bit of a greedy b***er and was hoping for a full refund and to keep the carpet, I had a feeling I wouldnt be allowed that though but thought I would check just in case.

    I will go in and see if I can find a suitable alternative, if there is no alternative I will have to ask about a discount then.

    Just be mindful that this may also be something called pile reversal - which is not typically a recognised manufacturer fault. It likely isn't, but something to consider.

    You aren't entitled to a full refund AND the carpet. You are either entitled to JUST the carpet (especially if pile reversal is a factor) OR to choose between the carpet and a [partial] refund (taking into account usage, which would likely entitle you to 100% here).
