14 day NIP/Summons rule?
Hello,
So, I know this will be a marmite thread, but there we go.
I ran a red light nearly 2 weeks ago and was caught by an unmarked beamer. No argument. I accepted on the side of the road that I was in the wrong. They took my details, give me a slip, told me within a couple of days I would receive a letter explaining their course of action.
Such letter is yet to come. Does the 14 day rule apply here? I assume I've been given the NIP already, so the 14 day rule does not apply. Is it 6 months then or not?
For the pious and self-righteous, I'm not in the business of avoiding blame, but as far as funding the police christmas party goes, I'm quite happy to avoid it if possible and feel no obligation to pay, especially considering the way the police have handled incidents in the past. I will pay, however, if the necessary papers turn up.

You are correct (no 14 day rule) and 6 months + a few days to hear from court0
-
You may hear nothing for quite a while and then it will be an offer of a course,an FPN or a court summons (depending on how serious the offence was deemed to be).
The fines/funds go to central government, not the police so you needn't worry about their party funding.0 -

With that in mind, I was assuming it'd be three points or a course?0 -
Often depends on how far into red it was. If it was 1-2 seconds then a fixed penalty or course is likely, >2 seconds then a summons becomes more likely. British Transport Police used to summons everyone who ran a red light at a level crossing, but lately seem to be going down the fixed penalty route as well.0

Even if it goes to court , it will still be 3pts, just the fine and costs will be bigger.
The outcome ( when cameras are used) is usally decided on "time into red" - i.e. how long the light had been red when you crossed.
With a police witnessed event it will depend on how they wrote up the incident, if it had only just gone red as you claim then a course or FPN is most likely - you just have to wait and see.
Bear in mind it is also technically an offence to go through on amber ( albeit with a defence if it was unsafe to stop).0 -

I will see what happens I guess.0 -
I'd say it'd had been red for no longer than a second. Probably less. The unmarked vehicle was quite a long distance behind me, but they told me it was caught on their dashcam (which they had running in front of me), so I assume this evidence will also be used in judging my conviction. The officer asked why I ran the red light and I explained that the weather had turned very bad (something he acknowledged) and I was checking my mirrors and caught the red light late (the road is a 50mph road). I said that I was sorry, that I wasn't going to contest it and that my only recourse was due to the weather I didn't feel safe slamming the brakes on. Next time I will, even if my car ends up sideways eh?
I will see what happens I guess.
Amber is lit for 3 seconds, plus a second on red - at 50mph you would have been about 100m away from the lights when they changed to amber , suggesting you couldn't stop in that distance without losing control is going to sound a bit lame (if it does go to court).0 -

For me, if I'm driving along a straight road and the lights are on green , then I proceed with caution as I'm expecting them to change at some point.0 -

Thanks for the help. I will be moving house soon, I assume I need to alert them so they can send the summons elsewhere?0
