I doubt your neighbour has any liability for the accident.
You will not only have a claim against you - you will also loose a portion of NCB. So I hope you didn't cancel with 15 years NCB for example then start a new policy with 15yrs as that is not the case any more unless you had it protected.
You should not have cancelled because the case had not been fully resolved. In order to have the case closed in your favor you need for the insurer to be reimbursed so would need to have demanded to pull their finger out and chase the third party.0 -
So it was being dealt with. If the third party are slow or reluctant to respond the claim will take time to resolve. I once waited nine months due to the third party playing dead. They came and inspected my car which was still parked in the same place, having not been moved since the incident, and went and spoke with the neighbour.
Cut to last week. The repairs to my vehicle had been authorised and carried out, and I had paid the excess of £250.
Because I had had appalling lack of service from my insurance Agent, I decided to cancel my policy on this vehicle.
They e mailed me an attachment of a letter from my insurers which said, no refund, case closed as fault!!!!
When I eventually came down off the ceiling I replied with an e-mail for an explanation. They again did not answer save to send another copy above attachment.
Later that day their 'claims department' left me a message to contact them, which I did, and they said 'what did I want?? Aparantly the insurance agency had e mailed them and told them to contact me!!.
Crux of the matter is this - Claims company were not aware that Insurers had closed the case saying I was at fault - they themselves still held the case as open and were considering taking Court procedings to force T****s to release their tracking information and accept blame.
How can an Insurance Company accept that I was at fault, when the car was correctly parked and I was not even in the vehicle and there was an eye witness, thus trashing my driving history?
I am not going to let this rest, but realistically has anyone ever sued their Insurance Agency and Company for restitution and re-instatement of their 'innocence'.
Any suggestions/comments would be gratefully received.
Cancelling mid claim was a particularly bad idea.
Most insurance companies these days use a separate claims handling company.
You seemed to have been being dealt with by the claims handling company, but were contacting your insurance agent for updates?0 -
In future, when insurers ask on their proposal forms whether you've had any policy cancelled mid term, you'll have to reply yes.0

You've really ballsed this one up mate. Insurance companies are !!!! mate, but you should not have cancelled part way through. You should have stuck it out until it was resolved. It can a long game. I've just recently had a dispute resolved that was started in January 2013.0 -

No he will not, he cancelled it, not them.
When I had an insurance company cancel a policy without refund (and charging a cancellation fee!) as a result of their !!!!-up I had a stroppy exchange of letters with them over several months and then they just started ignoring me. So, I wrote them a very detailed letter before claim with the result that they refunded me considerably more than just the cancellation fee and a pro rata premium for the outstanding period.
I told my current insurers about the cancellation and they couldn't give a stuff, they were perfectly happy to insure me at the regular premium.Je suis Charlie.0 -
To say I am confused and a little upset at some of the replies is putting it mildly!!
I came on here asking for advice not to be chastised. Because I have NEVER made a claim in 50 years of having insurance I have no idea of how the system works. I did what I thought was correct to the letter of the law which says I MUST have Insurance.
I have now sold the vehicle so it would have been, I believe unlawful and/or misguided to say the least not to advise the Insurance Agents that I no longer required cover on the said vehicle.
I am very upset about the 'people in glass houses' comment, not sure how this was relevant, and was certainly not a helpful comment.
I am female and I guess I am still very much in a 'mans' world'.
As I understand it my 'contract' is with the person to whom I make payment for a service which they supply. We are told time and again that the law states that the original provider of the service is not the person to contact in the case of a complaint, rather the person to whom we paid the money, and this is why my only contact was with the Agent who made no attempt to keep me informed, or even reply to my correspondence.
It was never about receiving any kind of rebate, purely because of the lack of service and the subsequent sale of the vehicle, and before anyone 'jumps on me' yes, the new purchaser is well aware of the damage and repair.
With regard to parking on the pavement, 2 nearside wheels on the payment which is only about 2 feet wide and the rest on the roadway.
But to get back to the point of my enquiry, how can I be found 'at fault' when parked correctly, not in the vehicle and with a witness who saw what happened. Regardless of the rights and wrong of the issue of cancellation, are you saying this makes me guilty by default?
I have other another policy with this agent so it will be extremely interesting to see how this will affect renewal! - Not that I would ever use their services again.
