Faultless insurance Record ruined!!

I have had a perfect driving history for over 50 years having never even had a parking ticket.


Several months' ago, my parked car was hit (grazed really) by a T***s delivery van whilst performing a 3 point turn in the cul de sac in which I reside. My sister witnessed this, but was unable to get the registration number before the van was away round the bend and out of sight. I telephoned the police who were not interested as I was not in my car, it was correctly parked and there were no injuries.


Rather stupidly I guess, I contacted the company who owned the van, and they told me their tracking system confirmed to them who was driving the vehicle, and they gave me details of their insurers.


I passed this on to my Insurance Agent. After I had heard nothing for about 3 weeks from them, I telephoned and they told me to contact their Claims Dept. which was a difference company altogether. Upon contacting them, they admitted we had 'slipped through the cracks' and no one had commenced dealing with the case!!


In the meantime I contacted our local police because a new neighbour had been parking on the pavement narrowing the road which I considered contributed to the incident. They came and inspected my car which was still parked in the same place, having not been moved since the incident, and went and spoke with the neighbour.


Cut to last week. The repairs to my vehicle had been authorised and carried out, and I had paid the excess of £250.


Because I had had appalling lack of service from my insurance Agent, I decided to cancel my policy on this vehicle.


They e mailed me an attachment of a letter from my insurers which said, no refund, case closed as fault!!!!


When I eventually came down off the ceiling I replied with an e-mail for an explanation. They again did not answer save to send another copy above attachment.


Later that day their 'claims department' left me a message to contact them, which I did, and they said 'what did I want?? Aparantly the insurance agency had e mailed them and told them to contact me!!.


Crux of the matter is this - Claims company were not aware that Insurers had closed the case saying I was at fault - they themselves still held the case as open and were considering taking Court procedings to force T****s to release their tracking information and accept blame.


How can an Insurance Company accept that I was at fault, when the car was correctly parked and I was not even in the vehicle and there was an eye witness, thus trashing my driving history?


I am not going to let this rest, but realistically has anyone ever sued their Insurance Agency and Company for restitution and re-instatement of their 'innocence'.


Any suggestions/comments would be gratefully received.

    Your"innocence" isn't in question. They have paid for a claim. Until someone reimburses them it will remain as a claim against you. You should not have cancelled.

    Becuase throwing your teddy's out of the pram isn't productive, the insurers cannot work on a closed account.
  • If you have issues with customer service you follow their complaint procedure till you exhausted all avenues, not cancel a policy mid claim.


    All claims are listed "At Fault" to all parties involved until blame and claim is settled.
  • I cancelled not in a fit of pique but because I was utterly disgusted at the 'lack' of any assistance/advice/contact from the Agent Company handling my insurance.


    I have now discovered that the Insurers 'closed' the claim weeks ago and not as a result of me cancelling.


    It was made quite clear that it had nothing to do with claiming a refund I realised I would never get any kind of refund, even being only a couple of month in, (of a 7 year old policy) purely, if you like more a 'punishment' for the Agent who has held my insurance business for nearly 10 years' now.


    Just a point the policy may have been closed, but I had paid in full at renewal so on that basis closing the cover early should have nothing to do with that, after all, what happens in a 'right off' when there is nothing left to cover?, the insurers won't act because they are no longer 'covering' anything, if a car is off the road for repairs, do they stop working on the policy?


    I think you have me all wrong, I am a sensible senior citizen not given to irrational behaviour, I am purely asking for constructive advise.

    With a write off (note correct spelling) the insurer will cancel the policy retaining the full premium.

    I don't think anyone has been destructive in their replies, as a SC and looking at the bigger picture, you must have loads of years NCB so even a one off claim is going to make little or no difference at renewal.

    I had been trying the customer complaint service for weeks, all I ever got was an e-mail from the agent saying 'see attachment' which was a letter from their claims department saying the matter is being dealt with.


    After weeks of the agent not responding to e mails, telephone calls letter through Royal Mail attempting to issue a Formal Complaint, I judged that perhaps losing business would work - apparently not, they have absolutely no scruples. I will not bore you with their latest reply, but their letter shows all the finness of a 7 year olds' first attempt at letter writing.


    It is like we've got your money now !!!!!! off!!!!
