Secure a Space Ltd

Received a parking ticket on a rainy Sunday 31/8 in a secure gated car park managed by Secure a Space on behalf of Comer Homes. My partner and I both reside in the property, but only have 1 space allocated. Tower Point.

Entry into the car park was by FOB. I have had tickets prior to this. I tried to contact Comer homes to complain about the issue, and state that there was no real loss to either Comer homes or Secure a Space, but the person responsible for parking was not willing to have that conversation or hear my complaint. I was directed to email her - but was not given the email address. I gave my number to be contacted but knew this wouldnt happen. I dont know if Comer Homes retain Secure a Space by way of paying them or letting them earn there own revenue.

I am weary of appealing over any other grounds than the charge does not reflect any real loss to Comer when so many spaces are vacant, and there are construction works occurring which have removed maybe 50 spaces from being accessed.

What next???

  • Read the NEWBIES thread and it will take you through it. It's written by the experts. Secure a space are BPA members.
    Presuming from your post there is one car park space and you have two cars? What does your lease/deeds say on parking? This is crucial to your argument with them.

    There is another way of contacting people. It involves taking a sheet of paper, inscribing systematic marks upon it with a pen, folding it and placing it in an envelope, inscribing further marks on the outside of the envelope to identify the name/location of the person you wish to contact, affixing a "stamp" to the outside of the envelope, and dropping it into a large red cylinder at the roadside somewhere near your home.

    @northlakes - Newbies thread says to start a new thread where Secure a Space are concerned. I am not a lease holder, I am a proivate AST tenant, with a 12 month contract. We have 1 space allocated - albeit no spaces are actually allocated. There is no number system in place, just paper permits that are logged by their ref number to the corresponding flat

    I have appealed to many tickets in my time, and won some too. The circumstances of those tickets were easier to argue. Ive used various forms of argument, and have even dabbled with freeman arguments.

    My only concern is the fact that entry is gained by a FOB, and therefore in some way implies that I abide by the terms of parking.

    I am aware of the Beavis case that is going to the Supreme Court.

    Im just not really sure how to proceed. I stopped reading the Newbie section as soon as it stated that Secure A Space requires its own thread

    Yup. You being given access doesn't mean all of the contractual terms are fair or valid. What does the invoice and contract say? Are they trying to imply part of the terms allow you to park wherever you want for a fee? Or are they trying to claim that breaching the conditions results in a fee?

    Either can be shot down pretty easily; it's just a disguised penalty.

    Do not overthink this. Most PPC charges have no basis in common law.


    If they are pursuing breach of contract they can only ask for sufficient to cover their losses which in most residential car parks are nil.
    You never know how far you can go until you go too far.
  • @The Deep - thats precisely what I am doing, over thinking this. But as I have had issues with PCN;s before, and further to an unlawful charge being enforced illegally by bailiffs and being uphelpd by police in attendance, I really cant deal with the elevated stress that the antagonism with these people brings...

    Yeah my research is dated given, but thats why I posted asking the question. I would have read more on the NEWBIE Thread, but as stated Secure a Space must be a different case in point.
