Taylor wimpey doesn't want to fix the garden

Hi all & thanks for help

I'm again here looking for advice I bought my 1st house from Taylor wimpey in new development area and Taylor Wimpey Had a full control of the area. I moved in last June & I found a steep in my garden about 7 bricks down at the side of my neighbour house. Taylor Wimpey built the house above my neighbour house for no reason and now they declined to to landscape the garden as it may cause damp for my neighbour. I got Landscape company and I sent their quotation to TW but they don't want to pay any thing.
now the garden is totally useless & unsafe for my kids as I can't put a chair without falling down.

I asked the conveyancer to open a case with them but he said it's not in his expertise.

Do I need to go to court for that.

    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    This is a bit confusing, what is "a steep" that you have in your garden?

    And why would anyone " build a house for no reason"?

    I think he means there's a slope in his garden, and his house is built to a slightly higher level than the neighbouring house "for no reason" (there will be one, and what it is is academic).

    Now TW are refusing to landscape the garden because they allege it would cause water to run towards the neighbours and create a damp problem.

    Clearly, that's rubbish. All it needs is some simple drainage.

    OP - what did your contract with TW specify about the finished state of the garden?

    from the garden door to my neighbour house wall at the back of the garden there is a slope around 30 degree. I mean my house built above the level of my neighbour house & the street.

    30 degrees...? Is that a guess, by any chance? If it really was that steep, then for every 10m of length, that's nearly 6m of rise. The end of a 10m garden would be about roof level to a two-storey house. You would probably only be able to walk up the garden on hands and knees.

    It's twice as steep as the famous Hovis advert hill...

    Even a fraction of that slope would have been VERY clearly visible when you looked at the site before reserving that particular plot.

    Stop the guessing, and give us a photo.

    Nothing in the contract about garden finishing. but they tried to say that gradient only appeared in one approved drawing of drainage but nothing in this drawing says the gradient mentioned is for garden.

    They tried to push me to open a case with NHBC but how I open a case with how approved the house to move in?

    Then you've got very little in the way of expectation of any garden finish... I think even having the garden turfed is normally an extra-cost option.

    I'm struggling a bit here to figure out how you didn't notice this minor mountain just outside the back door. Did you visit the site before reserving the plot? Or was the first time you saw the plot the day you moved on?

    If there really is this ski slope in your back garden, I think it's fairly safe to say that there IS a reason why your house is built to a higher level than the neighbours.

    Not sure who 'they' are, but NHBC wouldn't be interested in the garden, as they are concerned only with the fabric of the house itself.

    How much was the landscaping quote? Sounds like you'd be better off just paying it and having done with it...
