Last week my partner and I went to a bed store to order a mattress which is a wedding present from my Dad who is disabled. He gave me his bank card so I could pay for it in store. The total price was £394 including delivery and delivery is booked for Friday. Today I had a call from the bed shop and they said that I owe them money as they had accidently entered the amount as 349 instead of 394 and had only taken that amount and could I pay the money now! I said I couldn't as I don't have it and they said they can't deliver until I pay. I said it was a wedding present and that I can't afford to pay the extra and it would be difficult to ask my Dad for the extra when he thinks he has bought the present! They asked what I suggested so I said I suggest they deliver the bed as planned as it was not my error. Then I said I'd contact head office to see what they suggest. After this he said he will speak to the finance dept and get back to me but I'm still waiting. Any ideas of where I stand here?

I don't see what the problem is. Presumably you had your Dads agreement to pay the full price and he hasn't paid it all yet. Just borrow his card again or pay the difference and ask him to repay you.

Incompetent staff in the shop make an error and customer is expected to put it right. I would make a complaint to head office and explain what you have here. It is not your fault staff in the shop are useless!

That's a heavy comment, I would never go as far to say that staff are incompetent/useless purely because of a mistake. Those "useless" staff you talk about are real people with real lives/problems/hopes/ambitions/flaws.

No, especially not in a job. I think I am perfect!

    Cringe.

No. Like the rest of us, you are far from perfect.

OP, you had the money in the first place to make the purchase so what has changed? I think you are just chancing it a bit. UNLESS they deliberately mis-led you with the amount, in which case you have a completely different ball game (and one which can be argued).

She probably did, but like most threads on MSE some people just go on and on and on and on...

Thanks for everyone's interest. I was mainly interested to find out if there was a particular law that related to this but, as I suspected there isn't.

I am mainly annoyed because now I have to awkwardly explain to my Dad that he hasn't finished buying my present yet. As it was their mistake I find it slightly more inconvenient than if it was paid for on my card.

To the poster that tut tut-ed me (if I don't have POA) - Just because someone is disabled it doesn't mean they have reduced mental capacity. My Dad has full mental capacity and we have a trusting relationship... he just can't get to the shop himself. So, don't worry :)

Anyway, thanks for the interest. I will probably pay the extra myself when I can afford to and save myself the bother of telling my Dad as I hate accepting things and asking for things.

I wasnt implying he had reduced mental capacity. More on the legal aspects of it. Just for your info, this is a quote from a Lawyer regarding using someone elses debit card.
You can take money from a cash point with their permission. What you aren't allowed to do is go into a store and use it.

It makes sense if you think about it. If you did that you would be representing to staff within the store that you were that person. That would amount to a deception. But if you draw cash from a machine you aren't deceiving anybody.

One way around it is to draw cash from the machine and then pay for everything in cash.

If you were caught, to be wholly honest, I think you would get a conditional or an absolute discharge. Even Magistrates probably wouldn't get into a tantrum because you are doing some shopping for your parents with their permission!

Finally, something we can all agree on... ;)
