still theft too, as from completion I own the property and its contents?

Is the question mark because you haven't yet read your contract to check? I doubt that it's true. And even if it is, almost certainly not theft.

All that seems to have happened is that the seller has been a bit slow in clearing the property. Read countless threads here with buyers moaning about things being left behind. Would have been nice of them to discuss with you but, hey, they didn't.

Thanks for your replies so far...

In response to a few points raised:

    - I can't prove who did it, bit I didn't go to the property alone, so have a greater argument that the items existed
    - I don't really want someone's old furniture, but theft is theft and;
    - Most importantly intrusion is intrusion, and is illegal.

Incidentally the vendor was a 'so and so' for various reasons, and perhaps I should have known better, but hindsight is wonderful thing as we all know.

The outcome I'd like, personally, is whatever legal action can be taken for the intrusion because however trivial it's just not right, and compensation for the stolen items - not for the money, but the principle of it, I'll give any compensation to charity...

I can't believe the audacity of some people, and they get away with it, the problem never goes away...

When I had completed I went round with the keys to give it a clean to find some packing boxes remaining. It was obvious that the family were 'running behind' so I took myself off for a couple of hours and when I returned they had gone, at which point I changed the locks. Technically, it was my house at the time but I just let common sense prevail.

Yes, in your case a couple of days afterwards would have been out of order but they probably saw that you had not yet moved in and so felt it was ok to be a bit cheeky

it seems to me you have other anger issues which have nothing to do with the furniture.

you have no legal claim to the furniture : in fact if you had refused to hand it over, would open you to criminal charges.

you could however go to court and claim for your financial loses.

and of course change the locks

    .

In the heat of the moment you are understandably upset. Though your thoughts aren't rational. As your principles would waste a huge amount of peoples time at considerable cost to the taxpayer. In order for a few quid to be given a local charity. For items that you didn't even want to keep.
  • "Do you really believe its in the publics interest for the Police to spend time and money pursuing this for you?" - then burglary may as well be legal???

Forget it, move on, it's probably easier for others to say, with the greatest respect. All I want to understand is the legal implications of what has happened, then I can decide what to do, if anything...
