Seller/agent omitted important information about the house. Should we sue them?

    This is entirely up to you to do your research.

    I love living almost under a flight path (RAF Base), as we get so many interesting planes coming over, particulary when there are any air shows.

    It would never cross my mind to mention it, as it is just normal.

    Didn't you notice any planes during your visit? did you visit the property at different times of day to get a feel for the area?

    100% your responsibility to investigate if planes are something that annoy you.

    How long were the previous owners living there? Or the other neighbours?

    You wiill learn to love or ignore the planes.

    Surely you should have your own research, Google mapped it for example.
  • You certainly have my sympathy; especially if the noise is frequent and really bothers you. It can be hard to tell what an area is really like until one actually lives there, no matter ho often you pass through during the course of the transaction. Nobody had a moral or legal obligation to disclose it during the sale, though, I'm afraid.

    I do think you will get used to it fairly quickly if they are fairly small planes and don't come and go particularly frequently. My wife and I lived near an RAF base for a while and it never really bothered us. On occasions the noise was so loud the windows actually rattled, which amused us (although I'm not sure it still would these days, now that we have small children and want them to stay asleep as long as possible!!).

  • Nevermind the fact that surely you must know if an area is in a flight path or not just by looking at a map- if it was that big a make or break issue for you wouldn't you be sure to look up flight paths before purchasing a house? The vendor/agent can't be responsible for telling you every little detail about an area on the off-chance it might be a dealbreaker for you.

    Well at least you know you don't have to mention it when you sell!

    How many times did you go to the house, go around he area, go to local shops, talk to neighbours before you bought?
