Seller/agent omitted important information about the house. Should we sue them?

The day we moved to our new house we started seeing planes.
The house is directly underneath the fl;ight path of a nearby private airport!
We are so upset and feel cheated. Without a doubt we wouldn't have bought it if we had seen a plane passing by when we view it. No one told us anything and we feel it's a major thing. Should this have been disclosed, anyone knows?

Did the airline not tell you they were flying over the house either?
Perhaps you could sue them too.0 -
Up to you to check out the area.

Our house is on a flight path, it wasn't mentioned to us by the vendor or the agent but we had researched the local area, driven round at different times of day/night and seen/heard planes going over - it doesn't cause us any problems. I think you may struggle to get anywhere with this as far as your vendor and EA are concerned - it's hard to ensure you have checked everything you can and taken everything into account when you buy a new property but in my opinion, the responsibility of the EA can only go so far.0

Classic case of buyer beware. It is down to the buyer to visit at various times of the day and do their own research into the local area. A private airport is not a secret and could be easily discovered with a bit of research.
The seller and the EA have done nothing wrong, they only have to disclose things like this if they are directly asked.Determined to save and not squander!

I think you're onto a loser with this.
Surely this was down to you research the area and possible disruptions.
It's like people who move within stone throws of Silverstone and Brands Hatch and then complain about noise.:www: Progress Report :www:

It's not like the existence of the airport was a secret....
Would you expect to be able to sue a seller if they forgot to tell you that it rains there?0 -
So you didn't know there was an airport near you?
Sweet mother of God.
Are you aware that there is a road outside your house and those terribly noisy cars might just use it? Or people may walk down the footpath making very loud steps and, would you believe it, actually using their voices to communicate with each other?Eat vegetables and fear no creditors, rather than eat duck and hide.0 -
This is such an obvious thing that one wonders why you didn't see it on Google Earth.
Far more annoying is the fact that some really quiet areas with no airports, like parts of West Wales, are directly under the flight paths of large jets accelerating to cross the Atlantic. Result = constant background roar much of the time.
Or there's South Somerset with hovering helicopters out of Yeovilton for hours.
People who've bought in these sorts of areas have my sympathy, but like you, they have no means of redress.0 -
What sort of planes are we talking about here? Little single prop trainers? Or big commercial jets?0

That's not important information about the house. That's the sort of thing it's up to buyers to research, if they're bothered.
By this time next year you won't even notice them.0
