Sorry, did not read your post carefully. Their position depends on whether a possession order has been granted against them.excellent post dandelion, they didnt give notice they were served it. not sure why, ive not asked. there is no way they can retract or extend.

But don't take on board their problems. Do your best to reach the point at which you can exchange. If you can, then all is well. If you can't, then you can't.0 -
HOwever, after speaking to my solicitor this morning she has only just submitted our searches.
So... umm... when did you THINK they'd submit the searches? Or has there been no communication (either way) with regard to progress?
Whether they've been served notice or given it themselves makes no difference. If that notice expires in a couple of weeks, the landlord CANNOT just lock them out. The date notice expires is the absolute earliest that the landlord can apply for possession through the courts, and until that grinds through and reaches a conclusion, the tenant can stay put.0 -
i thought she had submitted searches when i had paid for them adrian, my mistake. I communicate every other day. I contact my solicitor not the other way round. She had never told me she hadnt submitted them.
Its local authority housing they live in, and apparently, they have had numerous letters stating they have to be out by this date and ignored them as they knew they were moving.0 -

Which doesn't affect the fact that the landlord - whoever they are - cannot, legally, do anything turf 'em out before possession is granted by a court. They can send all sorts of letters that warn of all sorts of dire consequences, but no more than that.
B'sides, since nobody's exchanged yet, any one person in the whole chain can still just click their fingers and the whole thing is off. Permanently.0 -
thank you gm, unfortunately im a worrier!! i take on everybodys worries unfortunately. My biggest fear, ultimately would be them pulling out, as if we dont move by september 20th, we cant move until october,
I did think it wasnt us being unreasonable, but i try to do right by everyone.
A very understandable view - however the key thing is to focus on doing what's right for you - you say the biggest worry is them pulling out - however would you risk exchanging (or would your mortgage company allow) without search results back - and would you even be going ahead with your purchase if the search results come back with some horror story in them. I would personally say that the risk of buying a horror story because you didn't take your time to ensure all searches were done and follow up queries answered to your satisfaction would be a bigger worry.
So focus on what you can control - the rest is stuff outside your control even if it impacts you.0 -
A nice calming post laidback, i suppose you have put it all into context for me, your right, there is no way i could exchange without searches back, as god only knows with my luck what we would end up with!! thank you laidbackgr, ive been with my other half many years, and we have never argued the way we have the last two days!!!
ive tried every scenario to make it easy for us all, but ive just inherited a two thousand pound bill for property we are buying, and there is no way i can stretch us any further!!0
