1. CPMS Manchester - cpmsmanchester.com
2. I'm sure we did but I'm at work at the moment and can't double check
1. CPMS Manchester is just a trading name, they don't exist as a legal entity. Can you upload the front page of the DRP letter (redact personal details) which shows the company they are writing about.
2. Check the NTK to see which company issued it.
I doubt that any of their signs say "CPMS Manchester" on them.0 -
So you don't need a defence along the lines of, the signage wasn't present etc, you argue it on the grounds of the sum
You argue on everything, signage, authority, amount, (unlawful penalty) planning permission, business rates, their losses, you throw the book at them. If they quote Beavis you shoot them down in flames.
You really have nothing to worry about, it is a con and they will not want it to be challenged in court. You never know how far you can go until you go too far.0 -

I've just received a debt reclamation letter (i.imgur.com/3UMLEx1.jpg). This isn't an LBC is it?
So I'm still at the point of waiting for the LBC to come through.
As a side note, is there any simple way I can find out who is the landlord of the property (apartments in town centre) so I can just message them and apologise to see if this works? I've tried Googling but no joy.
Surely you appealed not in your name but in the name of the rk, your wife, as advised? The driver wasn't the person to appeal, the keeper was. Just checking.
Anyway I have no idea why you showed that letter or even gave it a second thought, seeing as it's a standard Debt Recovery Plus one, covered in the NEWBIES thread post #4 in great detail (DRPlus and Zenith letter chain, boring, boring, boring). Thousands of threads talk pointlessly about that letter chain and have done for a decade. Thousands more threads can be found on Google or find pictures on Google images of the DRplus/Zenith letters to see what comes next.
Spare us these tedious letters, please. Read the NEWBIES thread post #4:

I've just checked the NTK (imgur.com/KX4tb9f.jpg) and it looks as though there was 64 days between the date of issue and the date of sending the NTK (at the earliest this would have been received after 65 days).
As the newbies guide points out Section 4, 8(5) of the PoFA says: "The relevant period for the purposes of sub-paragraph (4) is the period of 28 days following the period of 28 days beginning with the day after that on which the notice to driver was given."
Does this mean that CPMS are breaking the PoFA so the ticket is nullified? Can I just email them to say so or should I call?
Thanks again MSE.0 -
NEVER phone a parking firm.
And if you've named the driver, you've chucked all POFA arguments in the bin - I hope you appealed this as keeper (in your wife's name, or calling yourself the day to day keeper)?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

That's right, I used a random email account (with no real name as the address) and I've only contacted them twice:
1. Using the email template from the newbie guide
2. Requesting landlord details (to try sort it with landlord by just apologising etc.)
In the above I of course didn't take responsibility for anyone having parked, I didn't say '...a notice about me/my wife being parked...' so I believe this is as ambiguous as we need it to be?Hi,
Could I please have a contact number, address or email for the landlord of Met appts Manchester M1 2EH please? You have issued a notice about being parked on their land and I'd like to speak to the land owner to get this resolved.
Thanks0 -
Yes, sounds good, but when you say 'yes' do you mean you appealed as day to day keeper, or in your wife's name as registered keeper? Are the debt collector letters addressed to you or your wife?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi Coupon, I responded as keeper of the car / my wife and this is who the letters are addressed to.0 -

Good. Remember to stay in 'registered keeper mode' (wife's name) if you decide to respond.James_Howlett wrote: »Hi Coupon, I responded as keeper of the car / my wife and this is who the letters are addressed to.
Personally I would not bother to reply to the usual DRPlus or Zenith letter chain and would happily laugh at it again. But if you would rather try to stop the boring letter chain, the keeper could email to point out that the NTK missed the POFA deadline and as she wasn't driving and the driver has never been evidenced, they need to cease and desist with contact because she isn't legally liable.
If any letters mention 'keeper liability' then email the DVLA and report Debt Recovery Plus for this which is a serious error they've been picked up for recently:
david.dunford@dvla.gsi.gov.uk
But only bother him if the letters mention the POFA/registered keeper being liable, in which case stay in 'wife mode' and show him the offending letters in question as well as the NTK with the dates showing clearly. Thank you so much Coupon. I'm very grateful! I'll make sure to stay in 'wife mode' throughout the rest of contact.
Thanks again.0
