Should we advise people to appeal to the IAS?

YesI can't think of anything you would put in an IAS appeal that you wouldn't want to go to a court - you're still not going to be naming the driver or admitting anything.
I also thought it was pretty obvious that the PPC would try to use anything you send them (including the IAS appeal/rebuttal) in court, so I can't figure out why this is a reason not to appeal. Have you got an example?
Obviously they are also going to file claims for people who have lost at IAS (they are complete idiots after all), but it's quite likely that the PPC or IAS will say something in their correspondance that gives away an inconsistency. When you inevitably win in court on a point you made in your appeal, you've got an iron clad case for getting your costs back, as well as something pretty damning to use against the IAS.0 -

Seems this thread is short on facts and long on opinion.
I'm not sure the source, but someone managed to let slip that the IAS promise parking companies to reject 80% of appeals. I'm assuming it's part of their sales pitch and seems to play out about right. That said, it doesn't mean that are promising to uphold 20% either, but it's clearly heavily biased towards the PPC. Obviously, they can't offer a 100% rejection rate as that'd raise eyebrows.0 -
There is nothing to be gained from appealing to the IAS. The best you can hope for is that you don't screw it up and gift them a hostage to fortune. Not even worth taking the risk.
Remember, we are talking about OP's here, many of whom are capable of screwing up a note to the milkman. And it's not as if there's even a template for IAS appeals (and if there were they would still screw it up: just look how many screw up the PoPLA appeal templates).0 -
YesThere is nothing to be gained from appealing to the IAS.
I disagree, there is everything to be gained. Following their rules shows willingness to mitigate losses, and save court time..
At the end you will have an unsigned document, highly partial to the PPC which may well be perverse in law. Certainly not something which they would wish a judge to see, , and, it will cost them money.You never know how far you can go until you go too far.0 -

My advice is simple, if you feel you have a solid case then 100% appeal. I appealed and today got the result back that I had won.. no more parking fine!0
