This is what I am doing now. Still I also say, that its unprofessional and rather unhelpful that they have done this to me.
I wouldn't expect it, this is the first time its happened in 5 years or contracting and its not happened since.
I have yet to find a place where I can pay to find me a lawyer.
No I still haven't found one btwbut more
So did you go to the law society website ?
What happened to the 1 you were going to see 2 weeks ago ?0 -
Try a debt collection agency , I had a problem customer so contacted a debt collector , I had the money plus late payment fees within the week ......my customer (ex) was so impressed they now use the same debt collectors !
I cannot stress enough how much easier if is to collect debt if you terms and conditions and contracts /proof of agreement
Unfortunately if the debtor doesn't have the money no amount of legal action will get your money , especially if it's a ltd company ; however it may just stop them ripping off someone elseVuja De - the feeling you'll be here later0 -
How about taking them to the small claims tribunal:
https://www.citizensadvice.org.uk/law-and-rights/legal-system/taking-legal-action/small-claims/
These sites would also be worth checking out:
www.justice.gov.uk and www.judiciary.gov.uk , both mentioned at the end of the first link.
full.
The amount of money involved is too high for a Small Claims Court.
I do not think the Citizen Advice Bureau deals with business to business problems.0 -
Thanks again for the replies guys.
I did think about just cutting my loses and taking them to small claims court for £9.999. It might be easier. Although she threatened in her last letter to counter-sue me if I take legal action against her.
The lawyer I found said that their basic costs were more than I was claiming. So I didn't scope that very well.
As others have said, I don't really expect to get the money from them. In my head they are probably already wrapping up their company. However he did recommend as others have filming for the liquidation method. I just find the whole thing a bit daunting and very time consuming which right now I have very little. Hence the wanting to pay somebody to do it for me.
I did speak to my accountant and he said unfortunately he didn't know any, the ones he did he asked but they didn't want to get involved with anything like debt collection. So that didn't go anywhere.
I do have one more place I can think of. I am still hopeful as they aren't a giant solicitors.
With the debt collectors agency, wouldn't I have to prove to somebody before that? It seems odd that I could just go to them, when she feels she doesn't owe me anything as I delivered after a date we had agreed, even though I clearly said I can only deliver if she didn't delay in giving me everything required to carry out the building of the app.0 -
Give these guys a try? I've used them successfully on a couple of occasions now, they were recommended to me by Leeds Chamber of Commerce some years ago now. Nothing more than a happy customer, use them or don't, it's no big deal;

.
Can they countersue at the same Small Claims Court hearing as yours? I know that happens on Judge Judy (which is actually a small claims court btw) but I am not so sure it happens here.
If they do take you to court separately, does their case stand up? Are there any other people in your own business who you can go over your work with and give an opinion on anything they are likely to complain about?
It is sometimes too easy to feel isolated in these cases just because you have not many allies. Even competitors will often help in these occasions, especially in the specialist trades and professions.0 -

That is a great idea, I know many developers who could look over the code and tell me if it is over engineered. More to the point if you could sue a developer on the basis that they went out of their way to do this. Rather than it just being what the developer would normally do.
Nothing from the Client either, not since the letter where she outlined all of her reasons for not paying and warning about the counter sue.0
