He should get NI credits for WORKING
NI credits are different to contributions paid which give you qualifying years.

The term is used, generally, when people are not paying contributions but owing to receipt of certain benefits etc get credits on their NI account to make it a qualifying year.

In the case of the OP I would contact HMRC (Class 1 case worker?) as you want the employer to hand over back dated contributions to put things right to ensure that the years for which the contributions should have been deducted are correctly paid.

It doesn't pay to work in this country. Better to get everything done for you on benefits. Or just buy houses and get other people to work for you in effect.

Basically I meant he should have been Credited as working for the period concerned. So should have earned a year.

And he may not have been.

Thanks for the advice, the accountants are not being very forthcoming and it is their mistake!
We really need to get an exact amount from them to see what payments we have to make,he only has 2 years before retiral so it will have to be paid by then.

You can contact HMRC yourself and ask them the question - I'd do it that way around myself.

How can any halfway competent accountant miss the fact that someone isn't paying NI? Have you checked what his P60 says for tax year 2014-15? Does that show any employees NI? Also check what NI code is on his payslips. Is it C not A? If it is they have had his age wrong!

Go direct to HMRC certainly for the last tax year. With real time reporting they should be able to tell you the precise figure unpaid. Actually they should be able to tell you the figure to the end of July.

Personally I would cut the accountant out of the process completely, and tell him that the reason is because you (well your OH) doesn't trust him to get it right.

Thanks for the advice we will go direct to HMRC as we have now waited a week and had no response from the accountant.
On checking the P60 2014-15 there are no employees NI contributions also the NI code on the payslip has changed from A to C and also the payroll number changed at the same time all of which he should have noticed I suppose, anyway we will try HMRC and hopefully get some answers.

NI code C refers to someone over state pension age. This accountant has really scre*** up. I would definitely go via HMRC and not via the accountant as they will be trying to avoid any consequences of their actions

And go to DWP as I fear (as i said before) he hasn't earned his NI year+. You need to sort this properly as it will affect his State pension later

This is nothing to do with DWP. NI contributions are solely the responsibility of HMRC - the part that was "Contributions Agency" in days gone by.

Try 0300 200 3500 - it is a standard geographic number - no nasty charges.
