I can't remember what they quoted me when they called me, but they did say they use a certain exchance rate - strangely enough meant I was slightly worse off to! In the amount claimed on the Claim Form I included interest - and as posted above put a paragraph about that and the exchange rate in my PoC. So my claim form stated:

Court fee70.00
Legal representative’s costs0.00
Total amount994.610 -

Yes I settled but they made me do it the hard way !
They acknowledged and said they intended to defend the whole claim, then a week later called me to settle. I do wonder if it's their policy to not pay out unless a claim is issued in most cases.
I even sent them my draft particulars and said I will issue unless you pay me - they didn't reply so I did issue!0 -
Im going to try for Date of Delay for the Exchange rate, as when some cases have been struck out they are awarded this. Its a big difference, so worth a shot.
Seems to be conflicting opinions on this as you can see above, although depends if the judge follows the ruling given here:

Anyone chime in with any success stories and related exchange rate?

Well if Thomsons had followed this from the link you've put in:
"The flight district judge went on to rule that the exchange rate for converting the Euro sum into GBP should be the date that the court proceedings were issued by each passenger in question."
I'd have been better off! I can't remember what Thomsons came out with about exchange rate, I'm pretty sure it wasn't the exchange rate of the date of delay either. For me it was about £15 each so I couldn't be bothered to argue about it.0 -
I suppose it depends on the difference, as ours was from 4.5 years ago the pound wasnt as strong so about 160 pounds difference, i remember then the airlines just picking which date was better for them... and paying the least amount...0

Seems very strange to apply an exchange rate from the date of application... surely it has to be the exchange rate on the date of the loss. You mention it has been years since the loss... you do realise you have up to 6 years to make a claim from the date of loss or from the date you realised you incurred loss. Make sure you have followed the protocol before issuing a claim, and remember to include your court fee as part of your claim... do keep in mind though that if you lose... costs might be awarded against you.0

Yes, we been following stays and court ruling and sending letters and going to CAA, but its literally got no-where, tag this with having time to do things and read up on all the changes means we are here 4 and a half years later, so now its time to go in head first as it seems court action is sometimes the only way.
Like you said it should be from the date of delay, as we did complaint straight away and ask for compensation back then, even reported in when we arrived in Dominican Republic to the holiday rep, so really if they had done what was supposed to be done and paid then we would have that amount and not the lesser amount today. The airlines will do whats best for them obviously.
So if anyone has successfully claimed date of delay exchange rate with Thomsons without it getting struck out, then be good to hear.
