Advice on TSB Bank cheque clearing process please

Heres the story so far
my girlfriend received a cheque on wednesday 26th july, so 3 days ago
i drove to the bank to deposit it, as she was at work, it was a TSB bank, i walked in, and i had her debit card with me, so i asked the cashier to deposit the cheque to the bank account, i watched her take a piece of paper, fill in all the stuff, and put it next to the cheque and what looked like other cheques that were probably deposited on the same day. I didn't get a receipt, but i was told that if you are not using in a paying in slip then you don't tend to get them, anyway, it was done over the counter and stuff so i didnt see any reason to think anything was wrong.
Today we called TSB and they said that the cheque was not even showing up in the account yet, and we should call back on Monday since the branch i deposited into is closed on Saturdays.
What i would like advice for, is what should if monday comes and the cheque is still not showing? it was a personal injury cheque from a big company so im worried about what could happen if the cheque has been lost in transit or possibly put into the wrong account (which i dont think would be THAT likely since there arent THAT many people around that share her name)
does anyone have any experience with the TSB bank when it comes to cheques? should we be prepared to hear that there is some kind of problem - i.e. the bank cant find the cheque or something like that? should we call our solicitors and ask the company to cancel the check immediately and send another one - assuming that it could not have cleared yet?
any help would be great, we had been fighting our case for 3 years before finally getting a settlement, and im sure the company that gave us the cheque originally would love nothing more than to have us calling them and saying we need another one because the first has been lost in transit

Worst scenario is that you get the claims company to stop the cheque and issue a replacement.0

hello, not sure if this makes much difference, but it was not done through a claims company, but through our own solicitors
would it be a straightforward process to just call the company and ask them to re-issue, and if we told them to cancel the cheque, how many days from monday would we have before it would be 'too late'0 -
Going by the information from the TSB web site it would appear that the cheque has been lost.

this is what im thinking.. there seems to be absolutely zero reason for the cheque to not be showing up unless something is wrong, if it had been one working day i would understand, but after two whole working days, for them to be saying on the phone that there is no sign of a cheque in the account?
i have heard that SOME banks, the cheque will not show in your account until it has been cleared, but as youve seen, going by what the TSB website has said, something must have gone wrong
also, if for some reason, the cheque has cleared on monday, then what can we do about it? how long have you got to stop a cheque?0 -
As you can see from the link mentioned before TSB follows the standard 2, 4, 6 guide for clearance.
Because of the 'crossing' on the cheque they are bound by the Cheques Act 1992 not to pay it into any other account other than one to which the payee on the cheque is a party to. If they slip up then its their lookout because they can sued for 'conversion', depriving you of the value of the cheque.
If the cheque had been credited to an account Wednesday it would more than likely have debited the solicitors account Friday and therefore technically too late to stop. Your solicitors can help by talking to their bank about the 'paid' cheque and putting a trace on where the funds have been credited to. If the wrong account has been credited then its TSB's problem to sort out asap.
More than likely the cheque has not been paid into any account and simply gone missing. Hence the need for stopping the cheque and getting a replacement.0 -
hi henm2, im not actually sure who exactly the cheque came from, up till this point ive been assuming that it came from the company who was at fault themselves
if the cheque came from our solicitors i assume this wont be a big problem, im more worried about if it came from the company themselves
is there any scenario where we basically end up with nothing?0 -

There must have been other paperwork in the envelope.0 -

the letter with the cheque came from the solicitors, as the cheque was posted to them from the company (i assume)
and read something along the lines of 'we enclose the cheque of x amount for name, as agreed upon...'
which is why i say i dont actually know who the cheque came from, asin, did it come from our solicitors, or straight from the company themselves0 -
Don't panic ..........yet!
It could have been sent to the bank's clearing centre without actually being credited to her account.
The clearing centre in this instance would alert the branch that they have a cheque which has no corresponding entry and pass it to the account.
Either this or the cheque is still in the branch having not been processed at all.
Do not get the cheque stopped just yet.0 -

You probably don't want to hear this but you are not supposed to have somebody else's debit card as this is in breach of the T&Cs pertaining to that debit card. Did you use the card?
