And thank god I found out about this dispute thing, as I would have disputed and that's not the issue, didn't realise a dispute was saying you didn't think you needed to pay it back!
like I said thanks so much, I am sick with worry and all because we have done the correct thing.x
I feel your pain ! My " alleged " overpayment is huge ! I felt like crying yesterday with frustration because its such a simple thing and due to delays in dealing with papers they make it sooo complicated ! I was told they are allowed 6 weeks for mandatory reconsideration before I can call again !Stuck on the carousel in Disneyland's Fantasyland

The letter you get probably has a link to the HMRC charter:
https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/91888/charter.pdf
Item 3 of which is they will "Treat you as honest".
Yet in the letter they tell you they are ignoring your figures and using the RTI figures, without first even asking why the figures are different, despite there being lots of possible reasons for the difference.
Anyone who gets such a letter should complain to HMRC for breaching their own charter. Once everything is sorted.0 -

6 weeks, omg I have already waited 9 we are in financial difficulty as have gone from having £120 a week to £60 and was told it will go down to £35 in the next coming weeks.
We are entitled to the get the correct claim, and we are also entitled to be treated fairly, half of my frustration is the immoral way they treat you.
No fault of ours = weeks of stress = cant pay the rent = more stress......with our old award we were entitled to 0.83 pence housing benefit, we of course didn't claim it, seemed pointless as we could afford the rent, now we are on reduced income we need help with paying the rent, but housing benefit ask to see the tax credits award, which will show that we earned more than we did, so round in a vicious circle I go.0 -
The additional paperwork and time taken by both the claimant and the processing staff is so unnecessary if the addition of a 'box' or two on the claim form provided for legitimate allowances and deductions to be made in the first place!
What a bizarre system...0 -

As before the deadline, the previous year's income can still be corrected over the phone as long as it can be explained why your income differs from the RTI figures.
You don't even need to send in evidence of not specifically asked for by HMRC/Comcentrix.
this is not what I was told, I was told to send in the proof regardless by the nice man, he then stated that as we were being hit he would try and get the award corrected until things could be finalised, my issue is that they have obviously made a decision that an overpayment has occurred, so my proof will cross with the overpayment decision.
This is why it is such a silly way to deal with a simple process.0 -

Bizarre is not the word of choice I would use at this moment in time, but yes you have hit the nail on the head. ;-)0 -

I hope this is the case Blondebubbles I really do, thanks for everyone's help and advice, I have learned some things today, just seems so totally ridiculous.
I will keep you updated just so you can know how they resolve it, as it may come in useful for others in years to come, as I am sure that they will not learn from this.
Having people on here who are so willing to assist makes you feel less helpless ;-)0 -

It isn't needed at this stage, I did say to try and get it resolved but if it wasn't and the final award notice was issued then sending in a MR would be the right thing to do.
It is a ridiculous waste of time - it shouldn't happen in the first place but even if it does as you say the helpline should be able to correct it. I think they have had tighter controls put on them this year.

That's interesting.
Maybe the OP should just keep trying until he finds someone who will change it.

yes the nice man on the phone said he would alter the amount, as he could see that I had sent them in the correct details and that the issue was the pension deductions, he then said to send in all the proof as soon as possible so that it could all be confirmed, so I have just done that and hopefully this will not have to go to any other stage. ;-)
Ps: OP is a lady ;-) and a stressed lady at that....0
