    I'm in the same boat as well with a trading loss. I spent some of my redundancy setting up my business ( self employed ) but RTI has reported the full amount and that's what they are using !

    I've replied to their RTI letter and also sent in a mandatory reconsideration ! It's so simple but made sooo complicated by them. I'm now awaiting the change.

    I spoke to a nice chap last week who said he could override the RTI figure and he did - but then entered my losses as income so made it even worse and payments reduced again !

    A very helpful girl yesterday fully understood the figures - but couldn't enter them as the system was showing MR needed!

    This has been going on since beginning of May - its a joke !

    I'm doing my review in writing next year !

    Nope. They tell you not to send anything else with the renewal. If you do they throw it away apparently.

    Just to be clear - anyone with problems like this must make sure they file a Mandatory reconsideration/appeal and NOT a dispute.

    The man I spoke to at the main office told me not to wait for the finalised award to come through as it could take a further 2 weeks, and he could see that this issue needed immediate attention he told me to send all my pension info to the address below so that things could be rectified.
    HMRC, COMBEN HOUSE, FARRIERS WAY, NETHERTON, MERSEYSIDE, L751WB

    The man at overpayments section was rather unhelpful and said I had to wait for award and then dispute, when I said that could be a few more weeks he agreed, so when I asked him where I should send the forms he just said 'tax credits' not helpful as we have done nothing wrong!

    so now having spent a few hours hunting out the paperwork and bank statements for the last year to present day I am a little confused as to where to send the documents, don't want them going missing, although I will record delivery as it is sensitive information

    any advice?? please

    have just got all the paperwork sorted

    Just to be clear - anyone with problems like this must make sure they file a Mandatory reconsideration/appeal and NOT a dispute.


    Hi could you read my post and let me know what you think, as I was told to await award then dispute. (this was by the rude man at overpayments section)

    The nice man at main office said to send in all proof to the address I quoted.
    Was wondering if you had been through similar hence the advice you gave.

    yes that is the simple way, but as others have stated it doesn't work that way, why make it easy when they can cause you untold stress instead, seems so silly, a simple solution for a really simple issue, which is blown out of proportion, and as in our case results in a big overpayment and a large reduction in tax credits paid.

    This was the point I made to them, ask us why there is such a discrepancy before you make the assumption that we have been overpaid, we would not be so stupid to just pick a random income figure to give them when it is obvious they can check.

    If they had asked us for this weeks ago we could have sorted it out, now have cut our money by half, and we have already been struggling.

    I understand that people make errors, but I don't understand the poor attitude of the overpayments team, they seem to think you are guilty as charged.

    So annoying and frustrating, hence my post here.

    I have worked in the tax credit area for many years.

    You are doing the right thing trying to get them to change it. If they don't, then when you get the final award notice and initial award for those year - you will need to complete the appeal (mandatory reconsideration form) not the dispute form.

    A dispute is when the overpayment is correct but don't think you should have to pay it back.

    An appeal is where you think the amount awarded is wrong - that is what you are saying that the income should be lower and therefore the amount higher.

    I agree - the mandatory reconsideration will hopefully correct the incorrect figures and wipe off any overpayment - to simply dispute the " overpayment " is accepting the figures are right but not to actually " pay " the overpayment. These are two different things.

    Thankyou so much for this reply, I am going to send off all the paperwork to the address the man gave me and hope that someone will recognise that this mistake is theirs and not ours.

    And thank god I found out about this dispute thing, as I would have disputed and that's not the issue, didn't realise a dispute was saying you didn't think you needed to pay it back!

    like I said thanks so much, I am sick with worry and all because we have done the correct thing.x
