I am in the middle of it right now, the salesman who has messed it up has talked to the manager and now awaiting manager phone call and in the meantime the car is sitting in my driveway as it is not MOT'd

So not an actual MOT certificate then? MB cannot give you the right to drive without an MOT, so you should really know that at the time of purchase you were required to have an MOT in place for the day after the car had been registered for 3 years.
If you had bothered to check your paperwork, you should have asked how the MOT was to take place, whether it would be performed at the time of purchase or whether you were to return the car to the dealership to get it done. It should have been the former as the dealership aren't going to fix wear and tear items in order for it to go through the MOT FOC.
Yes the dealer made mistakes and they should make up for that, but it's your responsibility to check your paperwork.0 -

I always still receive a signed document stating date, time, when, where, the test was conducted, it even has section for advisories. Don't know an MOT place that doesn't issue one.
As for this thread, it's the drivers responsibility to check and ensure his vehicle is legal, not rely on something someone else has told him.0 -

It's only a receipt though, not a legal document and IIRC clearly states it is not a certificate.I hate football and do wish people wouldn't keep talking about it like it's the most important thing in the world0 -
Why did you buy an Approved Used Mercedes without full service history?
If you were buying cash it would have been better to go to CarGiant or indeed go to BCA and buy at less cost, lots of nice full service history ex lease Mercedes go through auction every week.0
