Where do I stand?
I bought a Mercedes C-class last year in December from Mercedes approved used car in London on full cash. At the time of purchase, the salesman gave me all the required paperwork showing the MOT is due in December 2015 and gave me no paper work for previous service history.
Now, I have decided to sell the car and took it to a local dealer. After checking the paperwork, he told me that there is no service history record and secondly the MOT was supposed to be done in February 2015 instead of December 2015 (as the car first registration is Feb'12). The DVLA records also showed no MOT history. Although, I have a document from Mercedes stating that MOT ends Dec'15.
My question is where do I stand, as it looks like I have been driving the car for last 5 months without any MOT as I was misinformed at the time of purchase plus also have the proof to back it up.
Will it be counted as a missold?

Is it a 12 plate then or a 62 plate. Take it back to the original dealer and make them buy it back. Show them the evidence of the wrong MOT date etc.0

What do you want? Your money back?
If they never claimed it had a full service history then you've no comeback on that, and as for the missing MOT I can't see that you've lost anything by it, except for 4 or 5 months' MOT when you get it done now rather than waiting 'til December. You could ask them for £20 for that I suppose.Je suis Charlie.0 -
Do you have a print out copy/receipt of the mot being done at the time of purchase?
Do you have any service history printed out, receipts or stamps in a book?
How do you know the new dealers not trying it on with service history?
It hasn't been mis sold as there was no mot required at the time of purchase. That's down to you.0 -

Had a quick look at their website, says nothing about checking service history.
As for the MOT, so they made a mistake. As I said, what do you want from them? I suppose you could ask them to MOT it F.O.C.Je suis Charlie.0 -
it states about History check, and I suppose MOT comes under that category so I believe they did breach the T&Cs as I was given a wrong paperwork regarding the MOT date.0
