They will not, cannot, use PoPLA. If they use IAS it will cost them money, so I would appeal. You never know how far you can go until you go too far.0

Yes thats why I thought I should remove that sentence, however I have sent the template as it was written out in the stickie as the initial appeal to PCM, which will of course be rejected.
I'll come back with their reply.....0 -

You should also consider the v.a.t. aspect.
This is supposed to be contractual charge ,which attracts v.a.t. Have they accounted for vat in their paperwork, if not you could ask for a vat invoice. Alternatively, if vat has not been accounted for it may well be liquidated damages for breach of contract and must be a GPEOL. some reading;

Would you suggest I therefore remove the lines below?
'I will only appeal further if you offer POPLA, the only independent ADR with a scrutiny panel and trained Assessors. The 'IAS' offered by IPC firms will not be used, for well-documented reasons.'
Or remove the whole of the 'Formal Challenge' paragraph?
Would you recommend anything else I need to add in its place?
To be frank, it doesn't matter much what you put in the initial appeal to PCM as they'll reject it anyway.
You might as well say you were set upon by a gang of oompa loompas who picked your car up and put it down where PCM found it parked because they heard you saying nasty things about the Charlie and the Chocolate Factory film.
Similar appeals have been lodged before - search for "Parking Prankster blog" on Google.
Just get your appeal in, you're thinking far too much about it."The darkest places in hell are reserved for those who maintain their neutrality in times of moral crisis." - Dante Alighieri0 -
Haha Yes I read that one about the radioactive spider, very amusing that they actually mentioned it in their reply.
Its probably just me but I hadn't realised the initial appeal did not need to be relevant. It just had to be a response that objected to all points whilst not disclosing the driver.
All done now but just a quick question, should I wait their reply until I ask for VAT invoice as the ticket clearly doesnt mention it. Or should I send a second email / letter asking for it immediately?0 -
Wait until they turn down you appeal, but certainly use it in a PoPLE appeal. You never know how far you can go until you go too far.0

PoPLE? Did you mean POPLA?
If yes then (as you yourself have already mentioned) POPLA doesn't apply here - it's IAS.0 -

A relevant appeal will make it look better for you should it somehow get to court, as you can use it to show them being unreasonable and get your expenses back from them.
But you're deluding yourself if you think it matters to the PPC; they'd reject any appeal you sent in, because they've got incentive to do so.0
