vodafone won't replace faulty phone

I posted this on the vodafone complaints thread, but wondering if it might be better here.
I have an LG G3 which keeps switching off. It has been repaired 3 times, and it still keeps switching off.
Initially vodafone said they would replace the phone, but now say they won't as I can do an early upgrade.
Apart from the fact I don't want an early upgrade, my limited knowledge of the legislation means that vodafone have to repair or replace the phone. They can't repair it, so they now have to replace it. Telling me to upgrade is the same as a shop telling me there is nothing they can do, so go away and buy a new one, is it not?
I am waiting for a manager to ring me back, but any information to back up my argument would be greatly appreciated

Whether you can early upgrade or not is immaterial. The device is faulty, there is no firm three strikes and replacement officially, but manufacturers generally, in my experience do this.
Keep pushing them, if they cant repair it then yes, it should be replace or refunded.0 -
Do not accept the line that you will have to start a new contract, either.0

I have no intention starting a new contract, and every intention of getting a new phone from them.

Doesn't it depend how old the phone is, ie if it is nearly 2 years old it will past the point where Vodafone have to replace?0

A refund would be difficult to calculate, I suspect that any mobile provider would be very reluctant to show the split between call and data provision and the actual cost of the handset, bearing in mind that they have attempted to repair the device three times, without success, the only alternative would be to replace.0 -

Why would they have to replace if it is out of warranty/gtee.
If it is in the first year of contract they should but i didn't think any phones were gteed past 12 months
Of course I may be talking crap , it's just my take but the OP hasn't said how old it is anyway0 -

If im not mistaken (it might have changed) but I think Vodafone cover the device for the duration of the original contract period.0
