Hi
All following our appeal to POPLA we have received this letter referring our case to the supreme court
Please help I don't want to go to court, if I pay up can this case be cancelled, do I contact popla to cancel it and say I want to Pay
See letter below
thanks
Dear Sir or Madam
Following the Court of Appeal judgment in ParkingEye Limited -v- Beavis (a
copy of which can be viewed on the POPLA website) a further appeal has
now been filed at the Supreme Court of the United Kingdom.
Where there is a specific application for an adjournment or where it appears,
or has already appeared, to the Assessor that there is no other issue upon
which the appeal could be determined, POPLA cases will be adjourned
pending a decision of the Supreme Court. There is currently no date fixed at
the Supreme Court but the Registry have indicated that the matter will not be
heard before the end of July 2016 and judgment will then be reserved.
However, the Appellant has indicated they will seek to have the matter linked
with another case due for hearing later this year.
Accordingly, your case will now be adjourned to a provisional date for
determination of Monday 9 November 2015. The position should become
clearer in the next few weeks, when the matter will be reviewed.
Yours sincerely

I think you've misunderstood the letter. You are not going to court, that is unless your name is Barry Beavis.
There is a Supreme Court hearing next week to determine the lawfullness (or not) of penalty clauses. Im guessing your POPLA appeal raises the point you have been charged a penalty.
What POPLA are saying is that is is difficult for them ro come to a conclussion as the law is now uncertain so your appeal is being delayed.0 -
umm , your case has NOT been referred to the supreme court
your popla appeal like many others is simply being put on hold until the outcome of bevis is known0 -
you are not going to court
its the Beavis case going to court , at the Supreme Court next week
so it all depends on what happens to his court case, and the decision wont be until say November 2015 , so they have stayed your case pending the Beavis case at the Supreme Court
once the decision is known , they will adjudicate your popla case according to the judges decisions on not a gpeol , probably before xmas
stop panicking ! lol0 -
Thank you so much, so I should just sit and wait till I hear from Popla again
thanks0 -

yes
or if you were to get a further evidence pack from the PPC a week or so before the new decision date they have given you (in november)
keep your fingers crossed for Barry Beavis winning his court case, if he wins , you will likely win
there are probably dozens if not hundreds of similar letters going out from popla at the moment, all stayed until the Beavis case is resolved
you have just given yourself a heart attack for no better reason that not reading the letter properly0 -
and by then the new mob will have taken over appeals , lets pray they have no kangaroo's in there closet0

Thank yes i had a mini heart attack thanks to the doctors here, I am back alive!!0

But watch out for Dr Shoe, he'd disconnect your life support system (do a forum search)! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Basically next week the supreme court are going to change hundreds of years English law and allow companies to fine customers with small print in contracts.
The decision will change consumer law as it is and has been and make the public the scapegoats of greedy corporations.
All to appease some rather crooked con artistes.
Well that is what will happen if Mr Beavis Loses.
Not just parking but the entire way that business to public services are dealt out is on the table.
We will see private firms fining customers for anything they see fit.
The Upside, is we wont need judges, solicitors or the judiciary, they can all be sacked , justice will be dispensed straight from your local corporation direct to the public.
Will they be clever enough to realise the decision effects the entire justice industry ?
Who knows, but why bother with law and courts when the business can just dish out a lawful fine in the shape of a contractual penalty.I do Contracts, all day every day.0
