If this was someone with a bit more knowledge and not Barry Beavis then everything might be ok. I know people try point out that consumer law is about to change forever but there is no way the examples people give will ever happen. Maybe banks start charging for late payments (oh wait) but no one is going to fine you for breaking a glass in fear of their own public reputation.

Thanks to this forum there are about 6 appeal points to choose from at POPLA! No doubt the PPC's will be on here giving it loads but in reality nothing has changed and nothing will change.
What I think is concerning is when the BPA become government-run and these private land 'fines' become as enforceable as council ones. Right now the PPC's have failed due to their own incompetence and these charges are so easy to overturn you may as well go buy a book of stamps and think of that as your weekly parking cost.Mike172 vs. UKCPM

It already happens. In a scam very reminiscent of the PPC racket certain budget hotel chains already rip people off for hundreds of pounds in spurious cleaning charges claiming that they smoked in their room (even when they didn't). They will go into a feeding frenzy if the Beavis case results in the legalisation of private penalty charges.
Most consumer transactions would be unaffected because the trader can't identify the consumer (thankfully we don't have registration numbers tattooed on our foreheads - yet!) but in circumstances where the consumer does identify himself (and/or where the trader is able to charge the consumer's credit card retrospectively) unscrupulous companies will fall over themselves in the rush to fill their boots with penalty charges.
Reputational damage versus a new income stream will be a cold commercial calculation, just as it is in PPC-world. Does Aldi care about the damage ParkingEye is doing to its reputation?
It will not happen with bank charges because the courts pegged them some years ago.Je suis Charlie.0 -

If you smoke in a non-smoking room you deserve to be sanctioned in some way, perhaps a contractual charge of £20-30 seems fair. If you were caught smoking in an aeroplane toilet it could cost you much more..You never know how far you can go until you go too far.0 -

I doubt Barry Beavis will be asked to contribute much.
All he needs do is be himself. The fact that he is not up to speed on the intricacy of the law should stand in his favour.You never know how far you can go until you go too far.0 -
POPLA is ending soon and you can guarantee the next bunch will be as bad as IPA and ignore what POPLA upheld.
If Beavis loses you can see the perfect storm on the horizon here.
People will just have to learn to park properly and read and obey the signs.
For those that take the pizz with double dipping and amnesic ANPR, shop somewhere else.
