Problems with Homebase and Faulty Goods

    They don't need to phone you, the decision to repair, replace or refund is for the retailer to make. All they have to do is ensure you are not unduly inconvenienced, which having ordered a new oven for you is what they have done. Take it and get on with life, there are more important things to worry about.

    I think you've misunderstood whats meant by a reduction in refund for usage you have had.

    That doesn't mean for how much you actually used it. Its for when you had it available for you to use.

    You can have something 10 years and use it twice, but you have still had use of it for 10 years.

    Like I said previously, under the Sale of Goods Act you are covered up to 6 years if the electrical goods develop problems.

    I have sent an email to Homebase this morning that if the manager does not make any urther contact by Monday, I am sending a letter of complaint to their Managing Director.

    I just cannot understand that I was given 2 faulty products in such a short space of time.

    I had also sent an email to Trading Standards asking for their advice, not heard anything yet.

    I think you know what I meant. Legally you've had 14 mths usage (or potential usage) out of the oven and as such any refund can be reduced to take that into account.

    No you are not!

    The SOGA, or rather the Limitations Act to be more precise, gives you 6 years to bring a claim, it does not mean you have a 6 year warranty for you goods.

    "The Sale of Goods Act 1979 says goods must be as described, satisfactory quality and fit for purpose. If goods are faulty, you can claim from the retailer".

    I think that says enough.

    I've had 2 faulty products so the act covers my issues.

    "If it isn’t, you can usually get one of the following:

    a repair
    a replacement
    your money back (a refund)
    some of your money back."

    I would expect a basic courtesy of a call with a proposal. In fact, if it is coming from a different retailer, I would expect that the proposal would be put in writing. If I had another retailer ringing up with the replacement out of the blue, I would be concerned that the original retailer would be washing their hands of the new one

    And the it is the retailer's choice which one they offer.

    As has been stated several times already the onus is actually on you to prove that the item is inherently faulty. Homebase have been very reasonable and have accepted your word for it as they could have asked you to provide them with an independent report in support of your claim.
